Fiscal Impact/Change to Net County Cost:
Payments to be made according to this reimbursement agreement total approximately $74,000 and are to be paid on a four-year schedule where the first payment includes a catch-up payment for three years of payments for a total of approximately $55,500.  The remaining annual payment will be paid within 30 days of June 5, 2010 and will equal approximately $18,500. Funding for this reimbursement has been included in the 2010 CIP and is programmed in the Zone 1-7 2004 General Plan Traffic Impact Mitigation (West Slope TIM). There is no Net County Cost.
 
Background:
The El Dorado County Board of Supervisors approved the "County of El Dorado Department of Transportation Guidelines for Road Impact Fee/Traffic Impact Mitigation Fee Reimbursement Projects" (Guidelines) on January 23, 1996.  Section 7.0 of these Guidelines specified reimbursement terms of four years (25% annual payments) for projects that were on the 5-year Capital Improvement Program ("CIP") and constructed by developers.  These guidelines were subsequently suspended in the El Dorado Hills area but are still in effect related to TIM fee zone 1 - 7 and therefore have been applied to this agreement.
 
Reason for Recommendation:
As a condition of PD03-0006/P03-0013, the Developer was required to provide improvement plans for construction of a traffic signal at the intersection of Missouri Flat Road and Golden Center Drive, and provide mast arms, signal poles, and cabinets for the traffic signal.  
 
Developer had prepared improvement plans titled "Project Plans for the Construction of Missouri Flat Road / Golden Center Drive Traffic Signalization" which were stamped by Kenneth D. Anderson, P.E. of K.D Anderson and Associates on April 13, 2006, and subsequently approved by the County Engineer.   The Developer has obtained KD Anderson and Associates' consent of the assignment of these plans.
 
Additionally, sidewalks were constructed as part of the plans titled "Improvement Plans for Golden Center Drive", stamped by Edward K. Binggeli of Bellecci & Associates, Inc. on September 1, 2005 and approved by the County Engineer.  Although repeated efforts were made by the Developer over a significant period of time, Bellechi & Associates, Inc. have not consented to allow these plans to be assigned to the County.  Because the structures and appurtenances constructed under direction of these plans were a very minor part of the overall signalization project, we recommend the Board waive the requirement for an Assignment and Assumption of these plans and approve the Reimbursement Agreement without a requirement to obtain such consent of the assignment from Bellechi & Associates, Inc.
 
The "Plans and Appurtenances" provided by Developer were utilized by the County as well as conduits and other facilities installed in 1999 by the County as part of the Missouri Flat widening project to construct the signalization project at the intersection of Golden Center Drive and Missouri Flat Road.
 
The El Dorado County Board of Supervisors accepted the signalization project as complete on June 5, 2007.
 
Action to be taken following Board approval:
1) The Chair will sign: a) The Reimbursement Agreement for the Engineering of the Traffic Signals and Acquisition of Related Appurtenances at the Intersection of Missouri Flat Road and Golden Center Drive between the County and Granite Grado Ventures - Project I, LLC; and b) The Assignment and Assumption of Plans and Specifications - "Project Plans for the Construction of Missouri Flat Road / Golden Center Drive Traffic Signalization"; and,
 
2) The Board Clerk will forward one original of each of the fully executed documents to the Department for further processing.
