Fiscal Impact/Change to Net County Cost: No change.  The Agreement is funded by the Federal/State Social Services allocation with required County match met primarily with realignment resources.  Funds were budgeted for FY 2009-10, are included in the Department's FY 2010-11 County Budget Request and will be budgeted for FY 2011-12.
 
Compensation for Services:  Payments are made to contractor based upon monthly invoicing at specified billing rates for actual services performed and documented per contract requirements. Services and rates are detailed on pages 5 through 8 of Amendment I.
 
Reason for Recommendation: The provision of inpatient and outpatient substance abuse testing and treatment services, residential or transitional living services, therapeutic counseling services and other related services continues to be a successful tool to improve the lives of families served by the Department of Human Services (DHS), while contracting out to local vendors continues to be the most efficient and cost effective method of delivering these services to eligible DHS clients.  Services are provided on an "as-requested' by DHS basis in accordance with treatment plans authorized by Department of Health Services Public Health staff working under an MOU with DHS to address client substance abuse issues to help them obtain or retain employment.  
 
Agreement for Services 778-S0911 with Progress House was approved and executed by the Board on June 30, 2009 for the provision of these services for eligible CalWORKs clients.  Amendment I revises Article I Scope of Services to clarify services provided and Article III Compensation for Services to include corresponding rates associated with these services.  It also adds Article XXX County Business License, Article XXXI Lobbying Restrictions and Article XXXII Fingerprinting which are standard provisions for current County contracts. Amendment I will be effective upon execution and the term remains July 1, 2009 through June 30, 2012 with no change to the total not-to-exceed compensation of $170,000 during the three-year term. The County Purchasing Agent has reviewed the Department's request for this amendment and concurs that it is in compliance with Board of Supervisors Policy C-17, sections 7.5 and 7.10.
 
This Agreement includes a provision allowing either party to terminate the contract without cause with 7 days written notice.
 
 
Action to be taken following Board approval:
1. Chair to sign two (2) originals of Amendment I to Agreement 778-S0911
2. Board Clerk to return one (1) original executed Amendment I of Agreement 778-S0911 to Human Services at 3057 Briw Road.
3.  Department to distribute as appropriate.
