Fiscal Impact/Change to Net County Cost:

There is no fiscal impact associated with this agenda item.  The table below details the effect that approving this Amendment would have on the County of El Dorado's (County) and California Transportation Commission's (CTC) funding obligation for the HOV Lanes Phase 1 Project (Project).  The County's obligation of $16.6 million would be reduced to $14.9 million, maintaining $1.9 million in County savings from the original County bid award savings of $4.4 million.  In addition, the original County bid award also had a savings of $3.5 million for the CTC's obligation that would have been returned to the CTC for other uses.  Approving this Amendment, in conjunction with the May 19, 2010 CTC approval of El Dorado County Transportation Commission's (EDCTC) Amendment of the Baseline Agreement will keep the $3.5 million CTC savings in the Project for the proposed additional Project scope.  There will be a subsequent agenda item for a construction change order for Board approval that will authorize the expenditure of the CTC's savings on the Project.  There is no net cost to the County's General Fund associated with this agenda item.

Background:

On April 22, 2008, your Board approved Caltrans Cooperative Agreement, District Agreement No. 03-351, County AGMT 08-1865, defining the responsibilities, terms and conditions by which Caltrans and El Dorado County together will construct High Occupancy Vehicle (HOV) and bus lanes on US Highway 50 from Latrobe Road to the Bass Lake Grade including replacement of the mainline bridges at El Dorado Hills Boulevard/Latrobe Road. This project is Phase 1 of a larger plan to add HOV lanes to US Highway 50 from El Dorado Hills to Shingle Springs.

 

On July 1, 2008, your Board approved Amendment 1 to the Cooperative Agreement to amend the scope and funding to add the eastbound offramp bridge and truck climbing lane extension.  

 

Reason for Recommendation:

The current Project limits are from PM 0.0 to PM 2.9 and due to safety and operational conflicts resulting from the proximity of the existing truck climbing lane merge and the HOV lane merge, Caltrans would not permit the utilization of pavement between PM 2.0 and 2.9.  The Department had expressed concern that the Project would create a mile of unusable pavement, which would be negatively viewed by the public.

 

The Project is currently under construction and has met all baseline agreement funding milestones.  The positive construction bid climate in 2008 resulted in a Project cost savings of $3.5 million in Corridor Mobility Improvement Account (CMIA) funds that would normally be returned to the CTC.  The CTC approved EDCTC's Amended Baseline Agreement on May 19, 2010, allowing the County to retain this $3.5 million in cost savings.  An additional $2.5 million in local funds from the County's bid savings will allow El Dorado County to propose a "change order" to the ongoing construction contract extending the eastbound HOV lane to PM 4.2 and provide for additional bridge construction at Bass Lake Road Interchange.  This eastbound extension, beyond the Bass Lake Road Interchange, will facilitate a safe merge of the HOV lane and allow full utilization of the public investment.  The $2.5 million in County funds is included in the FY 09/10 budget for the Project. 

 

Amendment 2 will replace Recitals 2 and 7; amend Section III, old Articles 2, 40 and 41; replace Exhibits A and A-1 with Exhibit A-2; and replace Exhibit B with Exhibit B-2.    

 

Pursuant to the El Dorado County Charter, Section 210b (6), the County may enter into any contract or agreement in cases where the Agreement is with or among any other governmental entities or agencies.

 

Action to be taken following Board approval:

1. The Board Chair will sign four (4) originals of Amendment 2 to Cooperative Agreement, (District Agreement No 03-0351, County AGMT 08-1685).

2. The Board Clerk will forward four (4) originals of the partially-executed Amendment to the Department to send to Caltrans for their review, approval and signature.

3. A fully-executed original Amendment will be returned to the Board Clerk for filing.
