Fiscal Impact/Change to Net County Cost: There is no net cost to the County General Fund associated with this First Amendment to Agreement for Services # AGMT 08-1677.
Reason for Recommendation:
On February 26, 2008, your Board approved for the U.S. 50 / Ponderosa Road / South Shingle Road Interchange Improvements Project (Project) an Agreement with David Evans and Associates, Inc. (Consultant), in the amount of $600,000, to provide project planning and design engineering services for the Department of Transportation (Department), with a scope of work that would result in acceptance by the County and Caltrans of a final Project Study Report/Project Report (PSR/PR) for this Project. This Agreement became effective on April 10, 2008, with all task work to be completed by the expiration date of June 30, 2010.
The primary purpose of this Amendment is to extend the expiration date of this Agreement to expire upon acceptance of the PSR/PR. Additional time is needed to allow for receipt of a biological opinion from the U.S. Fish & Wildlife Service and to complete National Environmental Protection Act (NEPA) and California Environmental Quality Act (CEQA) compliance requirements, all of which are required before final environmental documents can be certified and the final PSR/PR can be accepted by the County and Caltrans. Sufficient funds remain in the original not-to-exceed amount to provide for services through the extended term.
This First Amendment amends Article I, adding Amended Exhibit A, Amended Base Scope of Work, which ratifies the Contract Administrator's approval of the use of Dokken Engineering for Tasks F.1 and F.6 of Item of Work F, Environmental Documentation; Article II, to extend the June 30, 2010, expiration date to reflect expiration upon acceptance of the PSR/PR by County and Caltrans; Article III, adding Amended Exhibit B, to provide a current Fee Schedule for the extended term, and adding Amended Exhibit C, to amend the Cost Proposal to include Dokken Engineering as a subconsultant; Article XIV, to include Amended Exhibit A as part of this Assignment and Delegation Article; Article XIX, to change the title and address of one of the County's notice recipients; and Article XXVIII, to change the title of the Contract Administrator.
The El Dorado County Employees Association, Local 1, was informed of this proposed Amendment and Executive Director, Jere Copeland, has stated "We do not have an issue with this contract."
The Purchasing Agent concurs that the Consultant has demonstrated its ability to perform the work based on prior experience with this Consultant, qualifications of the Consultant, and the availability of the Consultant to perform the services. The Purchasing Agent concurs that the Department's request is in compliance with Board of Supervisors Policy C-17, Sections 7.4.2, 7.5, and 7.10.
Action to be taken following Board approval:
1. The Board Chair will sign two (2) originals of First Amendment to Agreement for Services # AGMT 08-1677 with David Evans and Associates, Inc.
2. The Board Clerk will forward one original of the fully executed First Amendment to the Department for further processing.
