Department of Human Services recommending the Board authorize the Chair to sign Amendment I to Agreement for Services 484-S0911 with the El Dorado County Office of Education for the provision of Child Abuse Prevention Council Coordinator services, adding Article XXIX requiring fingerprinting of El Dorado County Office of Education staff and volunteers, extending the term for one year through June 30, 2011 and increasing the maximum compensation by $113,850 for FY 2010-11 services, for a not-to-exceed amount of $291,625 during the contract term that commenced on January 1, 2009.
FUNDING: Agreement is 100% funded by the County of El Dorado’s Children’s Trust Fund and a portion of the annual State CAPIT Allocation.

Fiscal Impact/Change to Net County Cost: None. Funds were budgeted for FY 2008-09 and FY 2009-10, and the remainder is included in the FY 2010-11 County Budget Request. Funding sources are primarily the El Dorado County Children’s Trust Fund (CTF) and an annual allotment of up to $25,000 in El Dorado County Child Abuse Prevention, Intervention and Treatment (CAPIT) funds from the County’s State allocation. The California Department of Social Services has confirmed that it is appropriate to use a portion of the DHS annual CAPIT allocation to contract for CAPC coordination staff support. The current CTF balance is sufficient to cover all potential costs associated with this Agreement, with the exception of up to $40,000 allowed for grant activities that would be fully funded by future grants that CAPC may receive. Incoming revenue sources are expected to continue to replenish CTF balances. There is no County share of cost.
Compensation for Services: Payments to Contractor are made within 45 days following the County’s receipt and approval of itemized monthly invoices for actual CAPC-authorized services performed and documented per Agreement’s requirements. Allowable services are detailed on page 2 of Agreement’s Amendment I.
Termination: Agreement includes the County’s standard Fiscal Considerations termination language, as well as a provision for the County to terminate Agreement without cause in seven (7) calendar days upon written notice.
Background: Child Abuse Prevention Councils are legislated in California’s Welfare and Institutions Code §18980 which mandates that each county in the state establish a Child Abuse Prevention Council in order to carry out specific legislated functions within that county. On April 9, 2002, the County of El Dorado Board of Supervisors established a Child Abuse Prevention Council (CAPC) and designated that Council as the Children’s Trust Fund Commission. CAPC acts as an independent organization functioning within county government pursuant to Welfare and Institutions Code §18983.5 and in accordance with State of California directives and mandates.
The County of El Dorado’s Children’s Trust Fund (CTF) (#20-553-313, Index #7753313) consists of State revenues allocated among California counties from sources such as birth certificate surcharge fees and California Department of Motor Vehicles “Kids’ Plates” license plate revenues, as well as earned interest, grants and donations. As Commission of the Children’s Trust Fund, CAPC is authorized by Welfare and Institutions Code §18982.2 to accept donations, gifts and grants into the Children’s Trust Fund (CTF) and to spend money from the CTF for child abuse prevention efforts. The California Department of Social Services assigned the responsibility of administering the CTF to local county welfare departments. The Board of Supervisors adopted Resolutions Nos. 259-2005 and 356-2006 authorizing DHS to receive and deposit donation and grant funds on behalf of CAPC into the County of El Dorado CTF for CAPC to use for child abuse prevention activities. CAPC is a volunteer-based organization and has an ongoing need for staff support to coordinate, provide and/or assist with provision of CAPC child abuse prevention activities, related functions and services on its behalf.
As the County’s welfare department with responsibility for administering the Children’s Trust Fund, DHS determined that it is more cost-effective to contract out for these services. The vendor identified to provide CAPC Coordinator services, the El Dorado County Office of Education (EDCOE), was the sole qualified respondent to the County’s Request for Qualifications issued on July 11, 2008. Agreement 484-S0911 with the EDCOE for the provision of Child Abuse Prevention Council Coordinator services during the term January 1, 2009 through June 30, 2010 was approved and executed by the Board on February 3, 2009.
Reason For Recommendation: DHS, CAPC and EDCOE continue to share the mutual goal of preventing child abuse in the County of El Dorado through community-based educational efforts. EDCOE provides staff to support CAPC and coordinate or conduct the various community awareness, educational and training activities and events approved by CAPC to further child abuse prevention efforts throughout the County. Amendment I to Agreement 484-S0911 allows reimbursement to EDCOE for up to $38,150 for CAPC Coordinator staff salary and benefits during FY 10-11 and specifies annual not-to-exceed amounts for each category in which activities may be coordinated and/or conducted, including activities for potential future grants that CAPC may receive. DHS is submitting this Amendment I to Agreement #484-S0911 on behalf of CAPC to allow for the continued provision of CAPC Coordinator services during FY 10-11 in an amount not-to-exceed $113,850 for the fiscal year.
Purchasing Agent Recommendations: The County Purchasing Agent has reviewed the Department’s request to amend this Agreement and concurs that it is in compliance with Board of Supervisors Policy C-17. Procurement and Contracts prepared and issued Request for Qualifications (RFQ) 09-918-022 at the request of the Department of Human Services (DHS) for the provision of Child Abuse Prevention Council Coordinator services on July 11, 2008. The El Dorado County Office of Education was the sole qualified respondent, which negated the need for independent outside review.
