Fiscal Impact/Change to Net County Cost:  Funding for the contract is included in the FY 2010-11 Recommended Budget.  The contract administered by Public Health and funded from a General Fund contribution to Public Health for these costs.
 
Compensation Terms:  The adult and juvenile base amounts are invoiced in twelve (12) equal monthly invoices that are to be paid within forty-five (45) days of receipt and approval of invoice.   The amount is adjusted on July 1st of each fiscal year following the first year of this Agreement, by the percentage increase of the medical index of the CPI-u San Francisco-Oakland Region from February to February.  CFMG is liable for the first $20,000 of expenses incurred with each hospitalization and the County is responsible for the balance.
 
Background:  The County is responsible to provide medical, dental, and mental health care for inmates detained in adult corrections facilities, pursuant to Title 15, California Code of Regulations (CCR), Section 1200, and for Wards detained in the juvenile corrections facilities, pursuant to Title 15 CCR Section 1400.
 
The County has provided these services, with the exception of mental health services for juveniles, through a contract with California Forensic Medical Group since 1995 due to: (1) the difficulty recruiting and retaining licensed medical personnel to provide coverage up to twenty-four (24) hours a day, seven (7) days a week; (2) the exposure of potential violation of Title 15 should any gaps in coverage occur; and (3) the potential liability in serving this population (highly litigious).  Mental Health services within the juvenile faciities are provided by the County Health Services Department's Mental Health Division.  CFMG specializes in providing healthcare to jail and juvenile hall populations, and has proven to be a strong and reliable partner over the course of our relationship.  CFMG is dedicated to providing quality and cost-effective services in compliance with the Federal and State regulations regarding healthcare for detainees.
 
Reason for Recommendation:  The Health Services Department, working closely with the Sheriff's Department, Probation Department, and the Mental Health Division, has reviewed the service history of CFMG and recommends continuing to contract with CFMG for a variety of reasons which include:
 
1.      The provision of healthcare within correctional facilities is a highly regulated and specialized field of medicine;
2.      CFMG has extensive experience in such specialty care, providing Adult Correctional care services to twenty-seven (27) California counties and Juvenile Correctional care services to nineteen (19) California counties;
3.      To the best knowledge of the Health Services Department, CFMG is the only California-based private correctional medical, psychiatric, and dental contractor;
4.      The breadth and depth of services provided in California counties requires CFMG to remain current on California regulations regarding correctional healthcare;
5.      CFMG is able to recruit and hire licensed medical personnel to staff the facilities as needed, and also has flexibility in providing coverage due to the large pool of employees in California;
6.      In the event an Inmate or Ward must be hospitalized for care beyond that which can be provided in the correctional facility, CFMG communicates directly with the hospital personnel during the hospitalization, and manages aftercare upon discharge from the hospital.
7.  The County of El Dorado has been satisfied with the services provided by CFMG under the current contract.
 
Action to be taken following Board approval:
1. Chair to sign three (3) Agreements 018-125-P-E2010.
2. Board Clerk's Office to return two (2) signed Agreements to Department.
3. Department to distribute documents as appropriate.
