Fiscal Impact/Change to Net County Cost:  There is no Net County Cost associated with this Agreement 09-11270; in addition, this A01 does not change the original amount of the funding Agreement.
 
Background:  The Health Services Department has historically received funding from the State on an annual basis to be used for the County's Immunization Program.  The original Agreement 09-11270 was approved by the Board June 30, 2009 via Board item 09-0828; it was mailed to the State, and the fully executed Agreement was received from the State November 24, 2009.  
 
Retroactive Term:  This Amendment 1 (A01) is retroactive to July 1, 2009.  On June 9, 2010, Department received an inquiry from the State regarding the status of A01.  According to the State, it was mailed to the Department on November 24, 2009; however, extensive review of e-mails, contract databases and files, and other documentation indicates that no such Amendment was ever received by the Department.  In light of the late receipt of this Amendment A01 to that Agreement, Health Services Department has taken steps to ensure compliance with the Terms and Conditions of Amendment A01 to Agreement 09-11270.
 
On further discussion with CDPH Immunization Branch, in prior years the Immunization Program funding was provided by State local assistance funds; however, in FY 2009-10 the State local assistance funds were replaced by Federal funds via the American Recovery and Reinvestment Act (ARRA).  The Federal / State agreement requires that all subcontracters (i.e., CA counties) sign A01 agreeing to the ARRA Terms and Conditions.  The State is requesting that A01 be processed, signed, and returned to them by overnight delivery by June 30, 2010.   
 
Upon such notification, the Department immediately expedited processing and all parties to the process graciously accommodated the request.   
 
Reason for Recommendation:  The Department is now recommending the Board approve the Chair's signature on A01 so the County may continue to receive funding for the Immunization Program, and the State may satisfy the requirements of their Agreement for ARRA funding.
 
Action to be taken following Board approval:
1. Chair to sign six (6) original Amendments A01 to Agreement 09-11270;
2. Board Clerk's Office to immediately notify Department upon signature, so Department may retrieve all six (6) signed originals and overnight them to the State Department of Public Health; and
3. Upon receipt of a fully executed Amendment A01 from the State, Department to return one (1) signed original to the Board Clerk's Office.
