DISCUSSION / BACKGROUND
On January 28, 2025 (Item 17), the Board heard the Introduction (First Reading) of Ordinance 5223 to amend Title 5, Business License Ordinance, Section 5.08.160 and Continued the matter to February 4, 2025 for Final Passage (Second Reading).
The Home Occupations section of the El Dorado County Zoning Ordinance, Section 130.40.160. (Attachment D), was enacted to “provide opportunities for home-based businesses compatible with surrounding residential and agricultural uses in order to encourage home workplace alternatives, promote economic self-sufficiency of county residents, reduce commuting on U.S. Highway 50, while minimizing conflicts with adjacent property owners, maintaining the residential character of neighborhoods, and protecting the public health, safety, and welfare.” Sec. 130.40.160 subsection A.
County Ordinance Code, Title 5, County Business License Ordinance, currently requires all business license applications to be referred to Community Development Services, Planning and Building Department for review. The number of applications for home-based businesses has increased year over year. In fiscal year 2022-23, 1,222 new home occupation business licenses were issued; in fiscal year 2023-24, that number rose to 1,331. This fiscal year to date, over 900 home-based business licenses have been issued.
The Treasurer-Tax Collector is proposing an ordinance to streamline the business license process for home occupations that are allowed by right, as defined in the Home Occupation Use Matrix (Attachment D) This change would help manage the increasing volume of home-based businesses more efficiently and provide one-stop service for these small business owner-operators.
ALTERNATIVES
The Board could decide not to approve this Ordinance revision and all business license applications would be referred to Community Development Services.
