Fiscal Impact/Change to Net County Cost:
There is no direct fiscal impact associated with this Master Agreement. State funding for individual projects would be addressed in program supplements that are issued in accordance with this Master Agreement.

Reason for Recommendation:
The Department of Transportation (Department) is recommending approval and execution of this Master Agreement to assist the County in meeting its goal of delivering Capital Improvement Projects utilizing state funds made available through the State for transportation programs. Before state transportation funds will be made available for a specific program project where project will not receive any federal funds, Administering Agency (County) and State (Caltrans) are required to enter into an agreement to establish the terms and conditions applicable to the County when receiving state funds for a designated project facility and to subsequent operation and maintenance of that completed facility.

This Master Agreement applies County wide and includes, but is not limited to, the following state funded transportation programs: State Transportation Improvement Program (STIP), State and Local Partnership Program (SLPP) and Safe Routes to School (SR2S).

County Counsel and the Department of Transportation worked with Caltrans to modify the Federal provisions that were in the original agreement. Sections 17 and 18 of Article IV - Fiscal Provisions were changed to exclude subsections of 49 CFR Part 18.36 (i).
