Fiscal Impact/Change to Net County Cost:  
Funding for Rubicon Trail projects will be provided by grant funding in the amount of $1,209,000 from the California Department of Parks and Recreation, with matching funds in the amount of $651,326 from El Dorado-Sacramento Municipal Utility District Cooperation Agreement Fund (SMUD funds), $33,332 from the State Off-Highway Vehicle License Fees, and volunteer labor valued at $75,000 for a total cost of $1,968,658.
 
Background:
The Grants and Cooperative Agreements Program of the California Department of Parks and Recreation, Off-Highway Motor Vehicle Recreation Division provides financial assistance to public entities and other qualified entities to help with the management of off-highway recreation.  The Program supports planning, acquisition, development, maintenance, administration, operation, enforcement, restoration, and conservation of trails, trailheads, areas and other facilities associated with the use of off-highway motor vehicles.  
 
In 2009, the Department of Transportation was awarded three grants totaling $209,000 by the California Department of Parks and Recreation for ground operations, public outreach, education and development.  The work funded by these grants is either completed or underway at this time.  
 
On June 29, 2010, item 65, the Board of Supervisors received information on five (5) additional grant applications submitted for 2010/2011 to the Off-Highway Motor Vehicle Recreation Division for improvements to the Rubicon Trail that were then in the intent to award phase with the California Department of Parks and Recreation.  With that item the Board approved the maintenance activities proposed in the grants, authorized the Department of Transportation to begin staging work in June in anticipation of the final grant award, and authorized the Department to request the use of SMUD funds as a match for the grants.
 
Reason for Recommendation:  
The Board of Supervisors approval of the Project Agreements will facilitate the funding for Rubicon Trail improvements summarized below and assist the County in complying with the Cleanup and Abatement Order issued by the Central Valley Regional Water Quality Control Board.  
 
1) G09-03-06-G02 - Ground Operations Phase 1 will be completed this year and will address maintenance and sedimentation issues on the Rubicon Trail beginning at Loon Lake and Wentworth Springs to Little Sluice.
2) G09-03-06-G01 - Ground Operation Phase 2 will begin in January 2011, and will address maintenance and sedimentation issues along the Rubicon Trail beginning at Little Sluice and proceeding to the County line.  
3) G09-03-06-S01 - Education and Safety will provide the County with an educational video and public outreach materials related to the use of the Rubicon Trail.
4) G09-03-R01 - Route Variants Restoration will be completed this year and will address the variant routes that were not approved on January 26, 2010 when the Board of Supervisors recognized the preferred Rubicon Trail route.
5) G09-03-06-D01 - Restroom at Winter Camp.  Purchase and installation of the restroom at Winter Camp will be completed in 2011.
 
Delegation of signature authority is requested for the Director of Transportation to facilitate processing of the Project Agreements and any future amendments that do not change the dollar amount of the Project Agreements, subject to review and approval by County Counsel.  
 
Action to be taken following Board approval:
Authorize the Director of Transportation to sign four (4) originals of each of the five (5) Project Agreements and any future amendments that do not change the dollar amount of the Agreement.  The Department of Transportation will forward originals to the State Parks and Recreation Division for execution and return a fully executed Project Agreement for each grant to the Board of Supervisors for the file.
