Background:
On December 8, 2009, the Board of Supervisors authorized Department of Transportation's (DOT) Right of Way Unit staff to proceed with the right-of-way acquisition process to order preliminary title reports and certified appraisals for four (4) privately owned parcels for the Montgomery Estates Area 1 Erosion Control Project # 95155.

Reason for Recommendation:
DOT has been working to advance grant-funded projects for various drainage improvements to attain the environmental thresholds for water quality and soil conservation, and as such, would be a vast benefit to the quality of Lake Tahoe.  The named APNs that are within the Project areas defined herein were inadvertently omitted from the initial property net listing.  The possible impact of existing recorded encumbrances and impacts as they may relate to the Project planning for the scope of work requires further analysis for the Project planning and design.  The following parcels are to be included into the property net for processing:  025-433-08, CTC; 025-442-02, USFS; 025-442-06, USFS; 025-451-01, USFS; 025-452-02, USFS; 025-594-01, CTC; 025-595-09, USFS; 025-596-01, USFS; 025-596-02, USFS; 025-597-03, USFS; 025-621-03, CTC; 025-452-05, USFS; 025-452-06, USFS; 025-520-02, USFS; 025-644-04, USFS; 025-692-02, USFS; 025-692-03, USFS; 080-020-09, USFS.

Action to be taken following Board approval:
