Fiscal Impact/Change to Net County Cost:   There is no Net County Cost associated with these Agreements.  Budgeted amounts associated with these domestic violence service agreements have been included in the FY 2010-11 budget.
 
Background:   The Health Services Department maintains agreements for services with local domestic violence service providers which are fully funded by County marriage license tax revenue specifically designated to be used to support domestic violence programs and shelters, and payments made by offenders of domestic violence who have been granted probation.  The two domestic violence programs in the County of El Dorado (The Center for Violence-Free Relationships, and Womenspace Unlimited) have mutually agreed on the aforementioned funding being equally distributed between their two programs.
 
Compensation for Services:   Monthly payments are made to each Contractor, based upon available fund balance in the special revenue fund established for this program, following receipt of Contractor's monthly reporting (Exhibit A of Agreement).
 
Contract Termination:  These Agreements include the County's standard Fiscal Considerations termination language, as well as the County's standard provision for County to terminate the Agreement without cause upon seven (7) calendar days written notice.
 
Retroactive Term:   During the latter part of FY 09-10, the Health Services Department submitted a request for the County Procurement & Contracts Division to conduct a recertification of qualifications process in order to verify eligibility of providers requesting domestic violence services funding within the County of El Dorado.  As this recertification process is unique to these specific services, it was subsequently determined that additional time would be required for Procurement & Contracts to conduct the process.  To avoid any impact on the provision of these critical services within the community, it was determined that the Department should proceed with development of the proposed Agreements for FY 10-11; the recertification process will be conducted by Procurement & Contracts prior to any subsequent Agreements.  Upon this determination, the Department finalized the attached Agreements and scheduled them for review and approval of the Board as rapidly as possible.
 
Reason for Recommendation:   To ensure essential services for victims of domestic violence.
 
Action to be taken following Board approval:
1. Chair to sign three (3) original Agreements 050-114-P-E2010 and three (3) original Agreements 135-114-P-E2010.
2. Board Clerk's Office to return two (2) signed originals of each Agreement to Department.
3. Department to distribute documents as appropriate.
