Background:  The Department of Human Services, as the County agency responsible for the implementation of the State plan for the Foster Care Maintenance Payments Program and the Adoption Assistance Program established pursuant to Title lV-E of the Social Security Act, is responsible for supervising the reception, care and placement of children in foster care and publicly operated Probation facilities and for taking all necessary actions to assure maximum utilization of available funds for such purposes.
 
Pursuant to Section 727.1 (2) of the California Welfare and Institutions Code, hereinafter referred to as WIC, the Probation Department has the responsibility to establish, operate and maintain, or to contract with certain other entities for the operation and maintenance of various programs for the reception, care, and treatment of children placed in its custody by the Juvenile Court.
 
Reason for Recommendation:
 
Eligibility and Assistance Standards Sections 45-202.612 and 45-203.512 specify that responsibility for placement and care of children in foster care can be vested with County probation departments provided there is in effect a written signed agreement with the County welfare department.  The Department of Human Services and the Probation Department have entered into a memorandum of understanding to facilitate a foster care maintenance payment program as established pursuant to Title IV-E of the Social Security Act.
 
Since both departments utilize the same vendors to meet their program needs, amending the existing contracts with Human Services to include the Probation Department's wards of the court is more feasible than requiring separate agreements with the same service providers.  A list of those contracts being amended is attached for your review, as well as a sample amendment. It should be noted that Agreement #426-S0911 with the Mathiot Group Home is also being amended to increase the not to exceed amount to $250,000.00 and amending the contract term to perpetual.
 
 
Action to be taken following Board approval:  The department will route the contract amendments to County Counsel and Risk Management for approval and submit amendments to the Purchasing Agent for final execution.
