Title: Department of Human Services recommending the Board adopt a Resolution authorizing the Chair to sign Amendment 3 to Agreement 09B-5508 with the California Department of Community Services and Development, transferring funds between program budgets and reducing the total maximum contract amount by $26,141 from $1,527,054 to $1,500,913, for Low-Income Home Energy Assistance Program (LIHEAP) services to eligible residents of El Dorado and Alpine Counties during the term January 1, 2009 through September 30, 2010; and further authorizing the Department Director, or successor, to continue to administer Agreement 09B-5508 as amended and execute subsequent documents relating to said Agreement, including amendments thereto, contingent upon approval by County Counsel and Risk Management, that do not affect the dollar amount or the term, and any subsequent required fiscal and programmatic reports. Fiscal Impact/Change to Net County Cost: No change.
The reduction to the total amount paid to DHS under this contract was anticipated and included in the Department's FY 2010-11 Recommended Budget.
 
Background:
On February 24, 2009 the Board adopted Resolution No. 034-2009 authorizing the execution of Agreement 09B-5508 with the California Department of Community Services and Development (CSD) in the amount of $1,521,911 during the term January 1, 2009 through June 30, 2010.  On August 25, 2009 the Board adopted Resolution No. 194-2009 authorizing the execution of Amendment 1 to Agreement 09B-558, which allocated an additional $5,143 in funding for provision of LIHEAP services to eligible residents of El Dorado and Alpine Counties.  On August 3, 2010 the Board adopted Resolution No. 120-2010 authorizing the execution of Amendment 2 to Agreement 09B-5508 extending the term through September 30, 2010 with no change in the dollar amount.
 
Reason for Recommendation:
Amendment 3 to Agreement 09B-5508 reduces the total maximum contract amount paid to DHS by $26,141 from $1,527,054 to $1,500,913 with no change to the term.  On May 12, 2010 CSD authorized a transfer of funds in the amount of $26,141 from the LIHEAP EHA-16 Program Budget which provides vouchers for wood, propane, oil and cooling/heating system repairs and replacement (Exhibit B-Attachment II) to the LIHEAP Nonconsideration Allocations (Exhibit B-Attachment III) which provides for payment of utility bills.  A component of the LIHEAP program, funded by the nonconsideration allocations, includes payment of electric and gas bills on behalf of eligible low-income participants.  This transfer allows DHS to more appropriately meet the needs of the residents of the County of El Dorado by increasing the funding available to eligible participants for payment of electric and gas utility bills.  While DHS determines program eligibility and approves payment of electric and gas bills (up to the nonconsideration allocation amount determined by CSD), the State makes the payment directly to the utility vendor on behalf of the client.  Although CSD includes the nonconsideration allocations in the contract, these allocations are not included in the total maximum contract amount because nonconsideration allocations are paid directly to the utility companies and not to DHS.  
 
LIHEAP services have historically been in great demand, and high energy costs render them even more critical to the many frail, vulnerable residents on fixed incomes.
 
Action to be taken following Board approval:
Board Clerk to provide Human Services, at Briw Road, with three (3) certified resolutions and three (3) copies of Amendment 3 to Agreement 09B-5508 signed by the Chair.
Human Services to distribute as appropriate and return one fully executed Agreement to the Board Clerk.
