Fiscal Impact/Change to Net County Cost: There is no fiscal impact.  Funds are included in the budget and this amendment does not change the total funding amount.
 
Background:
On October 25, 2005, the AQMD Board of Directors awarded Funding Agreement (Agreement) No. 013-DMV-05/06-11 to DOT for Diesel Fleet Retrofits.  The original Funding Agreement, in the amount of $487,076 and for the term of October 25, 2005 through October 24, 2006, was to fund the retrofit of thirty four (34) on-road diesel fueled vehicles (vehicles) with the Cleaire Longview emission control device.  
 
On September 27, 2006, the AQMD Board of Directors approved Amendment I to the Agreement, which extended the project completion date to October 24, 2008, included Cleaire Horizon emission control devices with a cleaning unit and spare filters, and added one vehicle to be retrofitted for a total of thirty five (35) vehicles.  
 
On April 21, 2008, the AQMD Board of Directors approved Amendment II to the Agreement, which extended the project completion date to October 24, 2009, included Huss Umwelttechnik FS-MK series emission control device, addition of spare filters for the Cleaire Longview and Huss devices, eliminated seven (7) vehicles from the project scope based on lack of cost effective technology available for these vehicles, and added two (2) newly purchased vehicles to the project scope for a total of thirty (30) vehicles to be retrofitted.  
 
On September 29, 2009, the AQMD Board of Directors approved Amendment III to the Agreement, which added two (2) vehicles (#25-11 and 24-12) that were eliminated with Amendment II and extended the term to December 31, 2010 for a total of thirty two (32) vehicles to be retrofitted.  To date thirty (30) vehicles have been retrofitted: twelve (12) units with the Longview device, ten (10) units with the Horizon device, and eight (8) units with the Huss device and $436,104 has been spent on the project.  
 
The initial Diesel Fleet Retrofits proposal and subsequent amendments were prepared using the most current information available at the time of preparation; however, changes in emission control technology and the California Air Resources Board's (CARB) verification process continue to affect the completion of this project.  This Amendment IV extends the project completion date to June 30, 2012, to allow CARB enough time to complete the verification process of specific diesel retrofit devices that may be installed on the two vehicles added with Amendment III.  The total cost under the amended proposal remains the same at $649,434; $487,076 in AB2766 DMV Surcharge funds and the match of $162,358 being provided by the Road Fund.  
 
The attached Table 1 provides a detailed summary of the above described changes.  The final number of vehicles to be retrofitted with emission control devices has been reduced to thirty-two (32) from the original thirty-five (35).  This reduced the cost effectiveness of AQMD funding to $32.00/lb (from the original $22.05/lb) of NOx and PM emission reductions, which still leaves this project among the most cost effective projects funded with AB2766 DMV fees.   
 
Reason for Recommendation:
Approval of this project will, in addition to providing significant reductions of NOx and PM emissions from diesel fueled heavy duty vehicles, assure the County's compliance with the CARB On-Road Heavy-Duty Diesel-Fueled Public and Utility Fleets Rule.  The total funding award remains unchanged.
