Fiscal Impact/Change to Net County Cost:
The lease is funded by the Public Defender's Office and was included in the FY 2010-11 budget. The department will request an appropriation for the lease in FY 2011 -12 budget as well.
 
Background:
The Public Defender has been in a leased facility since 2002.  On December 10, 2009, the Board approved item 20, Amendment II to Lease Agreement 131-L0311, which reduced the lease payment by $31,146.24 per year to help meet budget reductions.
 
Reason for Recommendation:
The current lease expires on December 31, 2010 and the Public Defender's Office has expressed the need to exercise the option to extend for an additional one (1) year term commencing on January 1, 2011 and ending on December 31, 2011. The Lessor has agreed to continue the lease payments at the same fixed rate of $4,500 per month for the term of said extension.
 
Action to be taken following Board approval:
Upon approval of this extension, the Department of Transportation, Property Services Unit, will forward to Lessor official notification of the exercise of said option.
