Fiscal Impact/Change to Net County Cost:   There is no Net County Cost associated with this Amendment I to that Agreement.
 
Background:  On April 13, 2010, the Board of Supervisors approved the HOPWA funding Agreement with Sacramento County via Board Item 10-0289.  Sacramento County is the applicant/recipient for the Federal Housing and Urban Development (HUD) / HOPWA grant and serves as the fiscal intermediary for the allocation of HOPWA funds.  El Dorado and other local rural counties receive HOPWA funding through Sacramento County.  The HOPWA program provides emergency housing assistance for County of El Dorado residents and their families living with HIV disease.  Short term assistance and supportive services are provided to qualified persons for rent, mortgage, and utilities to prevent homelessness.
 
Compensation for Services:   Reimbursement for actual costs utilizing the electronic claim form process at Sacramento County, in accordance with Exhibit C, Item II of the funding Agreement.
 
Contract Termination:   Grantor may terminate this Agreement without cause upon thirty (30) days written notice; Grantor may terminate this Agreement immediately upon giving written notice should County materially fail to perform any of the covenants contained in this Agreement; Grantor may terminate this immediately upon giving written notice should funds be reduced or eliminated.
Retroactive Term:   Upon receiving this Amendment on October 15, 2010, the Department promptly began processing the Amendment through Department and County review processes.  All reasonable efforts were made to bring the Amendment before the Board as quickly as possible.
 
Reason for Recommendation:   Approval of this Amendment will allow the County to enhance services being provided to HOPWA clients via the subcontract with Sierra Foothills AIDS Foundation for the remainder of the term January 1, 2010 through December 31, 2010.   
 
Action to be taken following Board approval:
1) Chair to sign three (3) original Amendments 1 to Agreement 101-162-P-R2010.
2) Board Clerk's Office to return all signed Amendments to Department.
3) Department to submit all signed documents to Sacramento County for final signatures.
4) Upon receipt of fully executed Amendment I from Sacramento County, Department to submit one (1) fully executed Amendment I to the Board Clerk's Office.
