Health Services Department, Mental Health Division, recommending the Board authorize the Chair to sign Amendment I to Agreement 728-S0910 with Star View Adolescent Center, Inc., extending the term for one additional year to June 30, 2011 and increasing compensation by $242,530 to a new total of $300,000 to provide specialty mental health services for seriously emotionally disturbed minors on an as requested basis for said Department.
FUNDING: Medi-Cal/Early and Periodic Screening, Diagnosis and Treatment (EPSDT) funding, and/or Mental Health Realignment, based upon eligibility of each youth placed in this facility and specific services provided.

Fiscal Impact/Change to Net County Cost: The amount of this Amendment is $242,530 for a total contract amount of $300,000. The Mental Health Division (MHD) is responsible for paying the contract provider the total amount due for specialty mental health services and subsequently billing the State for Medi-Cal/EPSDT reimbursement. There is no Net County Cost associated with this Agreement.
Compensation for Services: Payments are made to Contractor based upon monthly invoicing at specified billing rates for actual services performed and documented per contract requirements. Services and rates are detailed in Exhibits C, D, E, and F of the contract and amendment documents.
Contract Termination: This Agreement includes the County's standard Fiscal Considerations termination language, as well as a provision for the County to terminate the Agreement without cause upon seven (7) calendar days written notice.
Reason for Recommendation: Star View Adolescent Center is a Community Treatment Facility, providing support and supervision in a locked facility twenty-four (24) hours per day, seven (7) days per week. Clients are placed through Department of Human Services and the funding for residential services is provided under a separate agreement between the vendor and the Department of Human Services. This Agreement provides reimbursement for specialty mental health services to youth placed in this facility. Specialty mental health services provided under this Agreement may include Day Treatment Intensive, Case Management, Medication Support, Therapeutic Behavioral Services, Crisis Intervention, as well as acute Psychiatric Health Facility services. An increase in the not-to-exceed amount of the Agreement is required due to a one-year extension of the Agreement's term and higher use of this facility than originally anticipated. The contract Amendment will allow the MHD to meet its obligations to provide specialty mental health services required for seriously emotionally disturbed youth.
Retroactive Term: MHD clients were placed at Star View Adolescent Center during the previous fiscal year. The term of the Agreement ran from November 9, 2009 through June 30, 2010, and MHD began efforts to amend the Agreement months before its expiration; however, lengthy discussions between the host county (i.e., LA County, where Star View is located) and MHD Finance were required to address and resolve issues associated primarily with compensation rates. It also took an extended time to draft, negotiate, and coordinate the Amendment through both the County's and Contractor's review and approval processes before the Amendment could be submitted for Board approval. Despite challenges and delays in processing this Amendment, it was necessary to continue to serve the individuals placed in this Contractor's facility in order to prevent any lapse in critical mental health services and the consequences that could result.
This Amendment extends the term of the agreement through through June 30, 2011.
Action to be taken following Board approval:
1. Chair to sign three (3) original Amendments.
2. Board Clerk's Office to return two (2) original Amendments to the Health Services Department, Mental Health Division.
3. Mental Health Division to distribute as appropriate.
