Fiscal Impact/Change to Net County Cost:  Funding is available in Fiscal Year 10/11 and will be budgeted in the FY11/12 and 12/13 recommended budgets.  There is no change in Net County Cost.  
 
Background:  
 
For the past three (3) years the Environmental Management Department has been satisfied with the work performed by said Consultant and is requesting approval to enter into an agreement for a total not to exceed amount of $300,000 for a three (3) year term for specialized engineering services related to the Union Mine Wastewater Treatment Facility on an "as needed" basis.
 
 
Reason for Recommendation:
 
The Environmental Management Department requests the Board authorize an Agreement with Psomas for specialized engineering services related to the Union Mine Wastewater Treatment Facility.  This Agreement has been written with a task order provision allowing the department to further define the tasks as needed and establish an appropriate budget related to the services identified in each task order.  Such tasks may include: design of storage tank aeration system, design of chlorine contact chambers, design of piping and pump systems connecting various treatment plant processes, construction management and quality assurance/quality control during construction.
 
Psomas (formerly Owen Engineering and Management Consultants) has over 40 years of specialized experience providing design and/or construction management waste water treatment facility engineering services for municipal agencies throughout Northern California including; El Dorado Irrigation District (EID), City of Placerville, City of Lodi, City of Manteca, City of San Jose, Calaveras County, Placer County, and U.C. Davis.  
 
The Environmental Management Department is requesting to enter into an agreement for a total not to exceed of $300,000 to expire three years from the date of execution.  An outside independent Consultant can more economically and feasibly perform the needed work in accordance with County Ordinance Chapter 3.13 as the Environmental Management Department does not possess the trained personnel or equipment necessary to perform the specialized engineering services.  Environmental Management has met with Local 1 and the Department of Transportation who both agree that an outside independent consultant can more economically and feasibly perform this needed work.  Pursuant to California Public Contract Code, Section 20121.1, day to day landfill operations are exempt for the competitive bid process.   
 
The County Officer or employee with responsibility for administering this agreement is Greg Stanton, Deputy Director of Environmental Management.  
 
Action to be taken following Board approval:
 
Upon execution by the Chair, the Board Clerk's Office will forward copies of the Agreement to the Environmental Management Department for distribution, encumbrance, and administration.
