Fiscal Impact/Change to Net County Cost: No change.  
The Agreement is 100% federally funded by the County's Low-Income Home Energy Assistance Program (LIHEAP) and Weatherization Assistance Program (WAP) grants.  Funds were budgeted for FY 2009-10 and FY 2010-11 and will be budgeted for FY 2011-12 and FY 2012-13.
 
Compensation:
Payments to contractor are made within forty-five (45) days following the County's receipt and approval of itemized invoices identifying services rendered, including the name of the program for which services were provided.  All costs are approved in writing by a Program Supervisor or Manager prior to the commencement of work.
 
Termination:
Agreement includes the County's standard Fiscal Considerations termination language as well as a provision for the County to terminate the Agreement without cause in seven (7) calendar days upon written notice.  
 
Reason for Recommendation:
The Department of Human Services (DHS) maintains purchase of services Agreements with multiple local vendors for the provision of heating and air conditioning system design, installation and repair services on an "as requested" basis to ensure clients of the LIHEAP and WAP programs receive necessary services from the most appropriate and conveniently located vendor.   On August 12, 2009, the County's Purchasing Agent executed Agreement for Services 089-S1010 with Jim Jonas Inc., dba Jonas Heating and Cooling, for a three-year term.  On August 16, 2010, the County's Purchasing Agent executed Amendment I to Agreement for Services 089-S1010 to increase the compensation by $18,505 from $40,000 to $58,505.  
 
DHS is recommending the continued use of this vendor's services as part of providing LIHEAP and WAP energy assistance to eligible low-income residents of El Dorado and Alpine counties.  Amendment II to Agreement for Services 089-S1010 increases the compensation amount by an additional $31,495 due to the increased and on-going demand for services provided.  The initial agreement was executed in August of 2009 and since that time Jonas Heating and Cooling has been very responsive to the department's need for emergency heating/cooling unit inspection and repair or replacement services.  
 
Article XXIII - "Notice to Parties" and Article XXV, "Access to Records", have been revised to be consistent with modified language approved for use in current County agreements.  Article XXXIV, "Debarment and Suspension Certification", Article XXXV - "Accounting Systems and Financial Records" and Article XXXVI - "Annual Audit" have been added to conform to current terms approved for use in County contracts.  Amendment II will be effective upon execution and the term will remain August 12, 2009 through August 11, 2012.  The amended total not-to-exceed compensation for the Agreement is $90,000.  
 
Action to be taken following Board approval:
1.  Chair to sign two (2) original Agreements
2.  Board Clerk to return one (1) original Agreement to the Department at 3057 Briw Rd.  
3.  Department to distribute as appropriate.
