Fiscal Impact/Change to Net County Cost:  The not-to-exceed amount of this Agreement is $125,000. There is no Net County Cost associated with this Agreement. Funding for this Agreement is included in the Department's FY 2010/11 budget.
 
Compensation for Services:   Payments are made to Contractor based upon monthly invoicing at specified billing rates for actual services performed and documented per contract requirements. Services and rates are detailed in Exhibit B of the contract.
Contract Termination:  This Agreement includes the County's standard Fiscal Considerations termination language, as well as a provision for the County to terminate the Agreement without cause in seven (7) calendar days upon written notice.
 
Reason for Recommendation:  California Psychiatric Transitions, Inc. (CPT) is a locked adult psychiatric facility in Delhi (Merced County) providing services to various counties in Northern California.  CPT provides symptom stabilization to seriously mentally ill adults with the goal being for patients to be able to return to less restrictive settings in the community.  CPT has been providing long-term 24-hour care and treatment to County adults (18 and older) for over five years.  Approval of this contract will allow the continued use of CPT's facility for seriously mentally ill adults who are in need of 24-hour residential care and treatment at various levels.
 
Most clients placed in the CPT facility have been found by the courts to be gravely disabled due to a mental disorder and placed on conservatorship under Welfare & Institutions Code section 5350 et seq. (Lanterman-Petris-Short Act).  When it is necessary to place a County client in the CPT treatment facility, the Health Services Department's Mental Health Division is financially responsible for the placement and mental health treatment costs.  CPT offers a number of treatment programs providing various types and levels of care, based on the client's needs.  The level of care required by clients is identified at the time of admission and reviewed every ninety (90) days thereafter.
 
Rates vary based on the services determined to be clinically appropriate for the specific client; however, even the highest level/highest cost treatment options are significantly more cost effective than use of State Hospitals.  In recent years, El Dorado County has had no State Hospital placements.
 
In accordance with Section 7.10 of the Procurement Policy, the Purchasing Agent has determined that it is appropriate to dispense with outside review of this vendor's qualifications as the Department is satisfied with the services previously received from CPT and additionally, the Department contracts with multiple vendors providing similar services in order to provide necessary client services.
 
Retroactive Term:  This Agreement covers the period April 1, 2011 through March 31, 2012.  MHD clients have been placed at this facility since September, 2010.  MHD began efforts to renew the Agreement before its expiration; however the new Agreement required substantial time and work with the vendor to update the Scope of Services and to conform to CPT's current rate structure.  Despite challenges and delays in processing this Agreement, it was necessary to continue to serve the individuals placed in the facility, in order to prevent any lapse in critical mental health services and the consequences that could result.
 
Action to be taken following Board approval:  
 
1.      Chair to sign three (3) original Agreements.
2.      Board Clerk's Office to return two (2) original Agreements to the Health Services Department, Mental Health Division.
3.      Mental Health Division to distribute as appropriate.
