Background: On August 17, 2010 the Board of Supervisors adopted Resolution 136-2010 agreeing to the exchange of tax increment as a result of the Meeks Bay Fire Protection District (FPD) reorganization.  At the time, Meeks Bay FPD proposed to annex 38 parcels, and detach 14 parcels.
 
On March 23, 2011 LAFCO exercised its authority granted under Government Code Section 56375(a)1 to amend the original reorganization from 52 parcels (38 to be annexed and 14 to be detached) to include only the annexation of 29 parcels containing existing structures.  On May 5, 2011 LAFCO notified the Chief Administrative Office that the original property tax increment redistribution as approved by the Board on August 17, 2011 was no longer applicable because the proposal area had been amended.  LAFCO is now requesting a renegotiation of the exchange.  The letter from LAFCO to the Chief Administrative Officer requesting renegotiation, together with the LAFCO resolution amending the original reorganization proposal is attached to this agenda item.
 
When LAFCO exercises its authority to amend a proposal such as this, Revenue and Taxation Code Section 99(b)(7) allows only 30 days for the affected taxing entities to renegotiate the exchange of of property tax revenues. Consequently, Meeks Bay FPD and the County of El Dorado have until June 4, 2011 to provide a certified copy of the exchange resolution to LAFCO.
 
Reason for Recommendation:  The Board of Supervisors adopted a resolution agreeing to the exchange of tax revenue with the original Meeks Bay FPD reorganization in August 2010.  The details of the renegotiation of tax revenue for the amended proposal are contained in Exhibits 2010-04-A2 and 2010-04-B2.  Other than the omission of parcels that were to be detached from Meeks Bay FPD, the details of the proposed exchange for tax rate areas where parcels are being annexed remain identical to the Board's August 2010 action.
 
Action to be taken following Board approval: Board Clerk to send adopted Resolution to affected agencies and LAFCO so the Commission can proceed with processing the application for annexation.
