Background: On an annual basis the Sheriff's Office leases a slip in the Tahoe Keys Marina for the boat that is used to conduct law enforcement operations during the annual boating season on Lake Tahoe. Previously, these costs were paid through a purchase order issued by the Purchasing Agent. However, the Tahoe Keys Marina recently changed ownership and the new owner requires all boat owners to sign a standardized slip rental agreement. Upon reviewing the original agreement, and based on discussions with County Counsel, the Sheriff's Office was unable to agree to the 'Liability and Indemnity' terms identified in the agreement. As a result, the Sheriff's Office recently completed negotiations with Tahoe Keys Marina to remove the 'Liability and Indemnity' language; however, this was not completed until May 2, 2011. Tahoe Keys Marina permitted the Sheriff's Office to begin using the boat slip with the understanding that the Sheriff's Office will be requesting approval of the agreement by your Board.
