Fiscal Impact/Change to Net County Cost:
No change.  A portion of the funds payable by the State to the County of El Dorado under this Agreement were budgeted in FY 2010-11 and included in the Department's FY 2011-12 Recommended Budget.  The Department's budget will be adjusted during the Addenda process to include the unanticipated increase in funding.
 
Background:
On March 29, 2011 the Board adopted Resolution No. 037-2011 authorizing the execution of Agreement 11B-5708 with the California Department of Community Services and Development (CSD) in the amount of $472,096 for the period January 1, 2011 through March 31, 2012.  On May 3, 2011 the Board adopted Resolution No. 069-2011 authorizing the execution of Amendment 1 to Agreement 11B-5708 increasing the agreement amount by $410,891, from $472,096 to $882,987.  Amendment 2 to Agreement 11B-5708 made changes to Exhibit B with no change to the total amount or term and was executed on April 28, 2011 by the Director of Department of Human Services as authorized by Resolution No. 037-2011.
 
Reason for Recommendation:
On May 26, 2011 the Department of Human Services (DHS) received notification from CSD that Amendment 3 to LIHEAP Agreement 11B-5708 would be released during the week of May 30, 2011 and that the signed Amendment must be returned no later than June 15, 2011 to allow CSD sufficient time to fully execute the Amendment and encumber the funds before June 30, 2011.  Amendment 3 to Agreement 11B-5708 was received on May 31, 2011 and processing has been expedited to ensure the June 15, 2011 deadline is met.  
 
Amendment 3 to Agreement 11B-5708 allocates an additional $545,530; $341,744 for provision of Energy Assistance and $203,786 for provision of Weatherization Assistance services to eligible residents of El Dorado and Alpine Counties.  The resolution further authorizes the Department Director, or successor, to continue to administer Agreement 11B-5708 as amended and execute subsequent documents relating to said Agreement, including amendments thereto, contingent upon approval by County Counsel and Risk Management, that do not affect the dollar amount or the term, and any subsequent required fiscal and programmatic reports.  LIHEAP services have historically been in great demand, and high energy costs render them even more critical to the many frail, vulnerable residents on fixed incomes.
 
Action to be taken following Board approval:
Board Clerk to provide Human Services, at Briw Road, with:
1.      Two (2) certified resolutions.
2.      Two (2) certified minute orders.
3.      Two (2) originals of Amendment 3 to Agreement 11B-5708 signed by the Chair.
 
Human Services to distribute as appropriate and return one fully executed Agreement to the Board Clerk.
