Fiscal Impact/Change to Net County Cost:   There is no Net County Cost associated with this Agreement.  Estimated costs and associated funding are included in the Department's budget.
 
Background:  The Substance Abuse Offender Treatment Program (OTP) was established in fiscal year (FY) 2006-07 per Health and Safety Code Division 10.10, Chapter 75, Statutes of 2006 (Assembly Bill 1808), and was funded by the State of California Department of Alcohol and Drug Programs to serve offenders who qualify for services under the Substance Abuse and Crime Prevention Act of 2000 (SACPA).  The State OTP Program was authorized for two years, and was to be repealed effective July 2009; therefore, effective FY 2009-10 the OTP State funding ended.
 
To ensure ongoing services through the County Alcohol and Drug Program (ADP), the County ADP Manager applied for and received American Recovery and Reinvestment Act funding through CalEMA and the California Department of Alcohol and Drug Program.  This is a one-time grant made available by the American Recovery and Reinvestment Act of 2009 and the funding is designated to be used to provide substance abuse treatment for criminal offenders in the County OTP Program.  The County has utilized this CalEMA grant funding to obtain the required treatment services through an Agreement with Progress House.
 
On February 15, 2011, the Board approved the Department's application for extension of the CalEMA grant through September 30, 2011.  Having received that extension, the Department now wishes to extend the term of its Agreement with Progress House to coincide with the funding grant extension.  Further, the Department recommends increasing the Not-to-Exceed amount of the Agreement with Progress House by $26,000, utilizing unexpended funds from the CalEMA grant, in order to allow for continued substance abuse treatment services through the extended term of the Agreement.
 
Compensation for Services:   Payments are made to the Contractor based upon monthly invoicing at specified billing rates for actual services performed and documented per contract requirements. Services and rates are detailed in Exhibit E - Service Reimbursement Schedule of the original Agreement.
 
Contract Termination:  This Agreement includes the County's standard Fiscal Considerations termination language, as well as the County's standard provision allowing the County to terminate the Agreement without cause upon seven (7) calendar days written notice.
Reason for Recommendation:   Approval of this Amendment I to the Agreement with Progress House will allow continuation of substance abuse treatment for criminal offenders in the County OTP Program.
Action to be taken following Board approval:
1)  Chair to sign three (3) original Amendments 1 to Agreement 097-135-P-E2009.
2)  Board Clerk's Office to return two (2) signed Amendments to Department.
3)  Department to distribute documents as appropriate.
