There is no fiscal impact and no change to Net County Cost associated with this item.
 
Background:
The California Environmental Quality Act (CEQA) and National Environmental Policy Act (NEPA) require public agencies to complete analyses of potential environmental effects associated with proposed projects. The Department of Transportation (DOT) is in need of assistance with such analyses to support projects included in the County's five-year Capital Improvement Program (CIP).
 
In late 2007, the County's Procurement and Contracts Office released a Request for Qualifications (RFQ) for DOT for a variety of transportation related disciplines. Based upon the results of the RFQ, North State Resources, Inc. was determined to be exceptionally qualified to provide the environmental support services needed by DOT. North State has a substantial amount of experience assisting rural counties with environmental review of transportation projects and with the California Department of Transportation's project development process.
 
On June 3, 2008, the Board approved Agreement #08-1683 with North State Resources, Inc. for on-call environmental review services in support of CIP projects and other DOT projects.  On May 11, 2010, the Board approved Amendment I to Agreement #08-1683 with North State Resources, Inc., extending the term for an additional year and establishing the contract expiration date of June 2, 2011.
 
Reason for Recommendation:
This Amendment II to AGMT #08-1683 is to extend the contract for an additional six months so that an outstanding Task Order issued (#08-1683-05) associated with environmental review services for the SMUD Trail CEQA/NEPA Documentation and Environmental Studies Project may be completed.  The Agreement shall expire on the completion of this outstanding Task Order #08-1683-05 or on December 31, 2011, whichever is earlier.  
 
DOT staff discovered toward the end of the term of the contract that the location of the bridge had to be changed.  This change resulted in the need for additional biological studies which in turn delayed project completion beyond the contract expiration date.  A retroactive contract amendment was therefore necessary to complete the project.   
 
The Procurement & Contracts (P&C) Division has reviewed DOT's request to process an Amendment to this Agreement and concurs that a competitive selection process, including evaluation by an outside reviewer, has occurred and has not expired. The P&C Division of the CAO's office concurs that DOT's request is in compliance with Board of Supervisor's Policy C-17, Sections 7.4.2, 7.5 and 7.10.
 
The El Dorado County Employee's Association, Local #1 was informed of this proposed contract amendment on May 25, 2011.
 
There is no increase in the not-to-exceed dollar amount of the contract.
 
Action to be taken following Board approval:
(1)  The Board Clerk to have the Chairman sign two (2) originals of
       Amendment II  to Agreement #08-1683 with North State Resources, Inc., and
(2)  The Board Clerk to forward one (1) fully-executed original Amendment II to
       the Department of Transportation for further processing.
