Health Services Department recommending the Board authorize the Chair to sign Memorandum of Understanding (MOU) 120-162-P-N2010 with California Superior Court of El Dorado County for the term July 1, 2011 through June 30, 2012 to provide continued Teen Court services.

Fiscal Impact/Change to Net County Cost: Participation by Health Services Department, Alcohol and Drug Program (ADP) staff is supported by SAPT Prevention Set-Aside funding available through the California Department of Alcohol and Drug Programs. There is no Net County Cost associated with this MOU and there is no remuneration between the parties to this MOU.
Background: Teen Court is a diversion program of the juvenile court, where juvenile offenders choose to be judged and sentenced by their peers after admitting to having committed offenses. The program is a collaborative effort involving the Health Services Department, Probation Department, District Attorney, Sheriff's Department and the Superior Court. Students recruited from high schools serve as jurors, prosecutors, defense attorneys, bailiffs, and court clerks. Adult attorneys from the community serve as mentors to the youth attorneys and a Superior Court Judge presides over the hearings. Sentences recommended by the juries include supportive and punitive measures.
Teen Court is an effective vehicle for education and early intervention with alcohol and drug issues for the youth that participate in the program; it has a successful completion rate of 85% due to the collaborative efforts of the Superior Court, County departments, and the community.
Compensation for Services: Not applicable - there is no remuneration associated with this MOU.
Contract Termination: This MOU contains a clause providing that in the event SAPT funding is reduced or eliminated the MOU will become immediately null and void. In addition, either party may terminate the MOU upon thirty (30) days written notice.
Retroactive Term: The Department received signed documents from the Court June 15, 2011 and prepared the documents for the next available Board date.
Reason for Recommendation: Approval of this MOU will allow continuation of the Teen Court program.
Action to be taken following Board approval:
1) Chair to sign three (3) Memorandum of Understanding 120-162-P-N2011.
2) Board Clerk's Office to return two (2) signed Memorandum of Understanding.
3) Department to process and distribute as appropriate.
