2) Comprehensive Drug Court Implementation (CDCI) Notice of Grant Award 332-162-P-R2011 in the amount of $93,420 for the term January 1, 2012 through December 31, 2012 to provide funding for the CDCI program.

Fiscal Impact/Change to Net County Cost:   There is no Net County Cost associated with these grant Agreements. Both grants require a twenty percent (20%) match, which the State has agreed may be satisfied by in-kind services paid through Substance Abuse Prevention and Treatment (SAPT) Federal Block Grant funding.
Background:    The Health Services Department, in collaboration with the Department of Human Services and the Superior Court, oversees the Dependency Drug Court program which provides treatment for parents whose substance abuse contributes to child abuse and/or neglect resulting in involvement with juvenile court dependency proceedings under the Welfare and Institutions (W&I) Code Section 300 et seq.  Funding for this program is provided by a CDCI-DDC grant from the California Department of Alcohol and Drug Programs.
 
Likewise, the Health Services Department, working with the Superior Court, oversees the Comprehensive Drug Court Implementation Program which provides treatment services for adults whose substance abuse results in court proceedings.
 
Payment Terms:  County will be reimbursed in arrears for actual allowable costs incurred under the grant programs. Reimbursement claims must be submitted to the State on a quarterly basis, no later than thirty (30) days after the end of each quarter.
 
Contract Termination:  These grant award agreements contain a "Fiscal Terms and Conditions" clause that states: "… if the State Budget Act or other legislative action results in insufficient funding for this Grant, this Grant shall be invalid and have no further force and effect. In this event, the Grantor shall have no liability to pay any funds whatsoever to the Grantee or to furnish any other consideration under this Grant and the Grantee shall not be obligated to perform pursuant to any provisions of this grant."  
 
Retroactive Term (DDC Grant only):  The Notice of Grant Award for DDC was received at the end of June and required development and submission of the Multiagency Plan (MAP) to qualify for funding. While the MAP was being developed, the grant award documents were reviewed and approved by Counsel and are now ready for submission upon approval by the Board.
 
Reason for Recommendation:   The Notice of Grant Award 332-162A-P-R2011 provides funding in the amount of $92,659 for the DDC Program for FY 2011-12. Approval of this grant notice will allow the County to continue to provide treatment for parents whose substance abuse contributes to child abuse and/or neglect resulting in involvement with juvenile court dependency proceedings.
 
The Notice of Grant Award 332-162-P-R2010 provides funding in the amount of $93,420 for the CDCI Program for calendar year 2012. Approval of this grant notice will allow the County to continue providing treatment for adults whose substance abuse has resulted in CDCI court proceedings.
 
Action to be taken following Board approval:
1) Chair to sign three (3) original Agreements 332-162A-P-R2011 (DDC-11/12-09); and three (3) original Agreements 332-162-P-R2011 (CDCI-11/12-09); and
2) Board Clerk's Office to return all signed Agreements for each grant to Department; and
3) Department to forward signed originals of both grant awards to the California Department of Alcohol and Drug Programs for final signature; and
4) Upon receipt of fully executed Agreements from the California Department of Alcohol and Drug Programs, Department to return one (1) fully executed CDCI Agreement, and one (1) fully executed DDC Agreement to the Board Clerk's Office.
