Fiscal Impact/Change to Net County Cost:
Acquisition costs are $600 with title and escrow fees estimated at $1,400 for a total estimated cost of $2,000.  Funding for the acquisition process will be provided by Tahoe Regional Planning Agency Mitigation Funds and California Tahoe Conservancy Grant Funds.
 
Background:
The Department of Transportation (Department) is working to advance the Christmas Valley Phase 2C Erosion Control Project (Project), which is included in the Department's Tahoe Environmental Improvement Program.  The Project will provide drainage improvements to enhance water quality and soil conservation by reducing erosion and sediment flow originating in the Project area in the Lake Tahoe Basin.  The Project is located in the Christmas Valley area, more specifically the streets of Santa Claus Drive, Saint Nick Way, the southern most end of Blitzen Road, and Elf Lane, including Christmas Valley Unit Nos. 1 and 2.
 
Reason for Recommendation:
Negotiations have concluded with the property owners, Lindsay and Carol Gong-Newell, Trustees of the Newell Family Trust Dated 2/26/2006, and a settlement has been reached that is representative of the appraised value of the land rights necessary for construction of the Project.  
 
Action to be taken following Board approval:
1. The Board Clerk will obtain the Chair's signature on the Temporary Construction Easement Acquisition Agreement and the Certificate of Acceptance.
2. The Board Clerk will return all executed documents to the Department for final processing.
