Title: Chief Administrative Office, Procurement and Contracts Division, recommending the Board: 1) Find that it is more economical to contract out for the on-call application of Type II Slurry Seal and Type II Black Rock Slurry Seal than to purchase equipment; 2) Waive minor irregularities in the responses to bid #12-988-005; 3) Award Bid No. 12-988-005 for the purchase of On-Call Application of Type II Slurry Seal and Type II Black Rock Slurry Seal to the low qualified bidder, California Pavement Maintenance Company, Inc. of Sacramento, CA; 4) Authorize the Purchasing Agent to sign a Contact in the amount of $200,000 for a one year period (sample attached), with most of the work being completed by October 15, 2011 following Board approval; and 5) Authorize the Purchasing Agent to sign increases on an "as needed" basis during the awarded period as long as funding is available within the requesting department's budget. FISCAL IMPACT/CHANGE TO NET COUNTY COST:  Procurement and Contracts has been advised that funding is available within The Department of Transportation's Road Fund budget.
 
REASON FOR RECOMMENDATION:  At the request of The Department of Transportation, the Procurement and Contracts division issued an Invitation to Bid for On-Call Application of Type II Slurry Seal and Type II Black Rock Slurry Seal. The Department of Transportation requests that the Board find it is more economical to contract out for the performance of Type II slurry surface treatment because the department doesn't own the equipment required to perform this type of work. There is approximately 1,044,000 square feet of roadway to covered by this bid.
 
Seventeen (17) invitations to bid were mailed; three (3) qualified responsible responses were received. No local vendors provide this service.  The Board of Supervisors is asked to waive Requirements A-D, G and H on page seven (7) of the bid (attached). None of the bidders provided this information and The Department of Transportation has assured that all of the bidders do meet the requirements and are capable of performing the Contracted work, including the recommended bidder.
 
ACTION TO BE TAKEN FOLLOWING APPROVAL:  Following Board approval, The Department of Transportation will issue a Contact to be signed by the Purchasing Agent in the amount of $200,000.00 for a one year period, with most of the work being completed by October 15, 2011 to California Pavement Maintenance Company, Inc. of Sacramento, CA. following Board approval.
