Department of Transportation recommending the Board:
1) Authorize the Chair to sign the Easement Acquisition Agreement for Public Purposes and Certificates of Acceptance for the related documents from Sierra Pacific Industries, a California Corporation, for Assessor's Parcel Number 010-040-08; and
2) Authorize the Director of Transportation or his designee to execute the escrow instructions and any other related escrow documents pertaining to the transaction, including the payment of title and escrow fees, for the Wentworth Springs Road at Gerle Creek - Bridge Replacement Project (JN 77118).
FUNDING: Highway Bridge Program Grant Funds with a match from the El Dorado-Sacramento Municipal Utility District Cooperation Agreement Fund (Index 8803311).

Fiscal Impact/Change to Net County Cost:
Acquisition costs are $3,000 with title and escrow fees estimated at $1,500 for a total estimated cost of $4,500. Funding for the acquisition process will be provided by Highway Bridge Program Grant Funds with a match from the El Dorado-Sacramento Municipal Utility District Cooperation Agreement Fund (Index 8803311).
Background:
The Department of Transportation (Department) has been working to advance the Wentworth Springs Road at Gerle Creek - Bridge Replacement Project (Project), which will provide a low water crossing over Gerle Creek on Wentworth Springs Road to be utilized by motor vehicles on the Rubicon Trail near Airport Flat Campground. On April 30, 2009, the Central Valley Regional Water Quality Control Board issued a Cleanup and Abatement Order for the Rubicon Trail, which includes this Project. On October 26, 2010, the Board authorized the Department to proceed with the acquisition process for the land rights necessary for the construction and completion of the Project. On May 17, 2011, the Board authorized the Department to make an offer to this property owner that was representative of the Waiver Valuation which was completed for these land rights.
Reason for Recommendation:
Negotiations have concluded with the property owner, SIERRA PACIFIC INDUSTRIES, a California Corporation, and a settlement has been reached that is representative of the appraised value of the necessary land rights. It is anticipated that the Department will begin construction on this Project during the 2012 construction season.
Action to be taken following Board approval:
1) The Clerk of the Board will obtain the Chair's signature on the Easement Acquisition Agreement for Public Purposes and the Certificates of Acceptance for the Grant of Road and Bridge Easement and the Temporary Construction Easement.
2) The Clerk of the Board will return all executed documents to the Department for final processing.
