Background:
The Durock Road/Business Drive Intersection Signalization Project (Project) required various slope, traffic signal appurtenances and temporary construction easements in order to construct the roadway and intersection signalization improvements.

On April 29, 2008 the Board authorized the Department of Transportation (Department) to proceed with negotiations to acquire land rights affecting portions of the subject parcel.  Negotiations with Robert and Wendy Deitz concluded and a settlement was reached that was representative of the appraised value of the necessary land rights.  Since that time, there were a number of design changes necessitated by further plan reviews and the need to construct the Project in the most economical manner possible.

Reason for Recommendation:
During construction, it was discovered that an additional area was necessary from the property owners to place an intersection light pole with a crosswalk controller.  After discussion with the property owners, it was decided that some construction work would be done to their parking lot to mitigate the wear and tear that had occurred during the construction period.  This work was acceptable to the property owners in exchange for the needed Traffic Signal Appurtenances Easement.

Action to be taken following Board approval:
1. The Clerk of the Board will obtain the Chair's signature on the Traffic Signal Appurtenances Easement and the Certificate of Acceptance.
2. The Clerk of the Board will return all original executed documents to the Department for final processing.
