Fiscal Impact/Change to Net County Cost: No change.  The Agreement is funded by Federal and State dollars with required County match met primarily with realignment resources.  Funding for the continuing services is included in the Department's FY 2011-12 budget.
 
Compensation: Payments to contractor are made within forty-five (45) days following the County's receipt and approval of itemized invoices identifying services rendered.  Compensation is based upon specified billing rates for actual services performed and documented per contract requirements.  Rates are tied to current Drug Medi-Cal reimbursement rates.  Services and rates are detailed on pages 3 through 4 of Amendment III.  
 
Termination: Agreement includes the County's standard Fiscal Considerations termination language as well as a provision for the County to terminate the Agreement without cause in seven (7) calendar days upon written notice.  
 
Reason for Recommendation:
The Department of Human Services (DHS) maintains agreements with multiple local and state vendors for the provision of therapeutic counseling and therapeutic visitation services to ensure that clients can be referred by their caseworkers on an "as requested" basis to receive necessary services from the most appropriate and conveniently located vendor.  Choice of vendor is based on the specific needs of each individual DHS client.  
 
The Purchasing Agent approved and executed Agreement for Services 648-S0910 with Teresa McIntyre-Harlow, Ph.D., on March 17, 2009, retroactive to January 27, 2009, for a three-year term in the amount of $20,000 for the provision of therapeutic counseling to DHS clients on an "as requested" basis.
 
On August 5, 2010, the Purchasing Agent approved and executed Amendment I to Agreement for Services 648-S0910 increasing the compensation amount by $38,505 to a not-to-exceed amount of $58,505.
 
On June 3, 2011 the Purchasing Agent approved and executed Amendment II to Agreement for Services 648-S0910 adding therapeutic visitation services.  There was no change to the dollar amount.
 
DHS is recommending the continued use of this vendor's services. Amendment III to Agreement for Services 648-S0910 amends Article III - "Compensation for Services," to increase the compensation amount by an additional $16,495 to a not-to-exceed amount of $75,000 due to the increased and on-going demand for services provided.  Teresa McIntyre-Harlow, Ph.D., is one of a limited number of available vendors in the local area who provide therapeutic visitation services.
 
Amendment III will be effective upon execution and the term will remain January 27, 2009 through January 26, 2012.  The amended total not-to-exceed compensation for the Agreement is $75,000.  
 
Purchasing Agent Review:  The County Purchasing Agent has reviewed the Department's request to amend this Agreement and concurs that it is in compliance with Board of Supervisors Policy C-17.  
 
Action to be taken following board approval:
1.  Chair to execute two (2) copies of the approved Amendment III to Agreement 648-S0910 and return one (1) original of the Amendment to Human Services at 3057 Briw Road.
2.  Department to distribute the document as appropriate.
