County Counsel recommending the Board authorize the Chair to sign Agreement 242-S1211 with Brady and Vinding for a term commencing April 26, 2011 for legal services in regard to all legal aspects related to the relationship between the County and the Shingle Springs Rancheria, and any related administrative proceedings or other matters.

Background/Reason for Recommendation:
The law firm of Scharff, Brady & Vinding is currently representing the county in regard to legal aspects related to the relationship between the County and the Shingle Springs Rancheria. Mike Brady has been the lawyer primarily dealing with the County's legal matters. As of April 26, 2011, the law firm of Scharff, Brady & Vinding split into to separate law firms; Brady & Vinding, and Jeffory J. Scharff. Brady & Vinding has continued to represent the County in this matter. County Counsel recommends that the County sign a new contract with Mr. Brady's new firm to continue the representation.
The Board has previously encumbered a sum of money for legal aspects related to casino litigation, which should be adequate for the balance of legal matters for the foreseeable future. Those funds can be transferred to cover the new contract.
Action to be taken following Board approval: Board Chair will sign the Agreement for Legal Services with copies for County Counsel and Brady & Vinding.
