Probation Department recommending the Board:

1) Make findings in accordance with County Ordinance Chapter 3.13, Section 3.13.030 that it is more economical and feasible to contract out with The California Department of Corrections and Rehabilitation, Division of Juvenile Justice to provide services under this Agreement C5608391 (Fenix 3670) to the Probation Department for youth referred in Juvenile Court;

2) Approve and authorize the Chief Probation Officer, or designee, to sign Agreement C5608391(Fenix 3670) with The California Department of Corrections and Rehabilitation, Division of Juvenile Justice to allow services of Diagnostic Studies, Treatment Services, and Temporary Detention for delinquent youth. This agreement is for a term beginning upon final execution and expiring on June 30, 2020, for a not to exceed amount of $99,904.00; and

DISCUSSION / BACKGROUND

The California Department of Corrections and Rehabilitation, Division of Juvenile Justice (“CDCR/DJJ”) agrees to provide Diagnostic Studies, Treatment Services and Temporary Detention for delinquent youth referred from Juvenile Court to the County of El Dorado.  The County of El Dorado agrees to compensate the CDCR/DJJ, for services performed at CDCR/DJJ facilities.

 

Staff is requesting the Board of Supervisors make findings that it is more economical and feasible to contract with CDCR/DJJ for services referred from Juvenile Court. Services provided by CDCR/DJJ are specialized and El Dorado County Probation does not have staff trained to provide these services. El Dorado County Probation will continue to utilize the specialized services provided by CDCR/DJJ for juvenile cases referred from Juvenile Court in the future as ordered by Court.

A Juvenile Court determines if a delinquent youth is eligible for commitment to the CDCR/DJJ, in any county in which there is a contract in effect, pursuant to Section 1752.1 and Section 1731.6 of the Welfare and Institutions Code (WIC). The Juvenile Court also determines if a delinquent youth is eligible for commitment by ensuring the youth falls within the provisions of WIC Section 1731.5, and concludes that a proper disposition of the youth’s case requires such observation and diagnosis as can be made by the CDCR/DJJ. 

 

The CDCR/DJJ contract allows for the Juvenile Court to order a youth to the CDCR/DJJ's 90 day Diagnostic commitment. The El Dorado County Probation Department has identified a need to fulfil the contract with CDCR/DJJ to allow eligible and appropriate youth to benefit from diagnostic services by obtaining treatment necessary to assist with personal growth, community safety, and in reducing recidivism.

FINANCIAL IMPACT

Funded with General Fund for Court Ordered Commitments.  Funding is included in the current fiscal year budget and the department's FY 2019-20 request.
