Department of Transportation, in cooperation with Planning and Building Department, recommending the Board approve and authorize the Purchasing Agent, or designee, to sign retroactively, the Second Amendment to Agreement for Services 442-S1710 with Kimley-Horn and Associates, Inc., extending the term for two years, increasing the not-to-exceed amount of $90,545 by $4,000, approving a change in rates, and minor edits to the Scope of Work, Task 6, for a total not-to-exceed amount of $94,545, for purpose of assistance in updating the County's Traffic Impact Mitigation Fee Program.

DISCUSSION / BACKGROUND
On May 12, 2017, the original Kimley-Horn and Associates, Inc., (KHA) Agreement (Attachment C) was approved by the Purchasing Agent to provide the necessary expertise to assist Planning staff with the update to the TIM Fee Program, as required by the adopted 2004 General Plan. The original Scope of Work included calculation of updated service volumes, a deficiency analysis, TIM Fee scenario analysis, recommended TIM Fee improvements, a presentation to the Board, and an update of the 2015 parcel map data.
On December 12, 2017 (Item 26), the Board directed staff to expedite the preparation of an amendment to the KHA Agreement, to amend the original Scope of Work to include the preparation of an addendum to the County’s Programmatic Environmental Impact Report (EIR) for the Western Slope Roadway Capital Improvement Program (CIP) and TIM Fee Program Update.
On January 9, 2018 (Item 27), the Board approved the First Amendment to the KHA Agreement amending the Scope of Work and increasing the not-to-exceed amount of $51,670 by $38,875, without a change in rates, for a total not-to-exceed amount of $90,545 and provided for consultant assistance to allow staff to move forward with a Technical Update, including moving of parcels in Zone 2 into Zone 8 (Attachment D). The proposed Amendment 2 will extend the term of the agreement from May 12, 2020 to May 12, 2022, change the Consultant’s rates to allow for cost of living increases, and provide for additional consultant assistance to complete work on the final remaining task, Task 6. The proposed Amendment 2 also includes minor edits to the Task 6 Scope of Work to update the existing base year (2015) and further year (2035) to reflect 2019 as the base year and 2040 as the future year.
Amended Task 6 - Additional Effort for Parcel Map Updates ($4,000 was added to the previous amount for Task 6)
Additional funds are being requested to complete Task 6 - Parcel Map Updates.
ALTERNATIVES
The Board could decide to not approve this Amendment 2. If the Amendment is not approved, delays would be expected in project delivery.
OTHER DEPARTMENT / AGENCY INVOLVEMENT
The proposed Amendment 2 has been approved by County Counsel and Risk Management.
CAO RECOMMENDATION
It is recommended that the Board approve this item.
FINANCIAL IMPACT
There is no change to Net County Cost associated with this item. Funds are available in the Department's budget and no budget amendment is required.
