Fiscal Impact/Change to Net County Cost:
Acquisition costs are $1,600 with title and escrow fees estimated at $1,400 for a total estimated cost of $3,000.  Funding for the acquisition process will be provided by Tahoe Regional Planning Agency Mitigation Funds and United States Forest Service Lake Tahoe Basin Management Unit Grant Funds.
 
Background:
The Department of Transportation (Department) has been working to advance the Sawmill 2A Bike Path & Erosion Control Project (Project), which is intended to provide a critical link in the regional Lake Tahoe bicycle path network and will stabilize soil and improve storm water quality within the Project area, in addition to perfecting the land-rights ownership as they pertain to the implied dedication road easement known as Sawmill Road.  On December 10, 2009 the Board authorized the Department to proceed with the acquisition process for the land rights necessary for the construction and completion of the Project.
 
Reason for Recommendation:
Negotiations have concluded with the property owner, George L. Carrere, Trustee of the Lucille H. Lampson Trust dated July 17, 1996, and a settlement has been reached that is representative of the appraised value of the necessary land rights.  The Department will begin construction in August 2011.  
 
The Project is located south of Lake Tahoe Boulevard along Sawmill Road and northwest of US Highway 50.
 
Action to be taken following Board approval:
1)  The Board Clerk will obtain the Chair's signature on the Easement Acquisition Agreement and the Certificates of Acceptance for the Grant of Road and Public Utilities Easement, the Temporary Construction Easement and the Grant of Drainage Easement.
2)  The Board Clerk will return all executed documents to the Department for final processing.
