Fiscal Impact/Change to Net County Cost:
There is no net County cost or fiscal impact associated with this agenda item.
Background:
The Board adopted the Resolution of Intent to Vacate on May 11, 2010, as Resolution No. 053-2010. Per Section 8313 of the California Streets and Highways Code, and Section 65402(a) of the California Government Code, a hearing was held on April 22, 2010 for a Finding of Consistency to the General Plan by the County of El Dorado Planning Commission, and the conformed agenda for that hearing is hereby submitted to the Board of Supervisors as Exhibit D.
Reason for Recommendation:
The Department of Transportation (DOT) filed for record in May, 2009, the Notice of Completion, Document No. 2009-23932, for the White Rock Road Realignment and Widening Project #72401. With the new roadway realignment completed, the remaining segment of White Rock Road (now referred to as old White Rock Road) is the section of roadway that is the subject of this General Vacation process as described in Exhibits A, A-1, A-2, A-3 and A-4 and depicted on Exhibits B, B-1, B-2, B-3, and B-4 attached to this Resolution of Vacation. The subject roadway is located south of US Highway 50, west of Latrobe Road and lies between Windfield Way on the west boundary and Latrobe Road on the east boundary.
Site development plans have been submitted to the DOT, which identify the relocation of utility facilities to other areas parallel to the new realigned roadway. A T & T, Comcast, El Dorado Irrigation District and P G & E, have submitted written communication indicating they have no objection to the proposed vacation as long as certain exceptions and reservations are provided to allow for completion of construction for the replacement facilities.
The Department of Transportation has reviewed the General Vacation request to vacate, and has determined that there are no plans to extend or expand said roadway and has no objection to the proposed abandonment as the old roadway is unnecessary for present or prospective public use as a non-motorized facility.
Action to be taken following Board approval:
1) The Resolution of Vacation will be recorded by the Board Clerk.
2) Copies of the recorded Resolution of Vacation will be mailed to the affected property owners by DOT staff.
