1) Make findings pursuant to Section 3.13.030 (E) of the El Dorado County Ordinance Chapter 3.13, Contracting Out, that the Child Abuse Prevention Council activities administered by El Dorado County Office of Education (EDCOE) is with or among any other governmental entities or agencies;

2) Make findings in accordance with Procurement Policy C-17 Section 3.4(2f) exempting the competitive bidding process, with Purchasing Agent concurrence, because the procurement is for services where the continuity of providers will provide efficiency or critical knowledge, and other providers of the services cannot provide similar efficiencies or critical knowledge;

3) Approve and authorize the Chair to sign Agreement for Services 9572 with EDCOE, in the amount of $430,000, and for the term of 2 years and 10 months, from August 26, 2025, through June 30, 2028;

4) Authorize the Purchasing Agent to execute amendments relating to Agreement 9572, contingent upon approval by County Counsel and Risk Management, which do not increase the maximum dollar amount or term of the Agreement beyond three years; and

5) Authorize the HHSA Director, or the Chief Assistant Director, to execute programmatic, administrative, and fiscal documents relating to Agreement 9572.

 

FUNDING: 22% Community-Based Child Abuse Prevention allocation; 15% Promoting Safe and Stable Families allocation; 46% Child Abuse Prevention, Intervention, and Treatment allocation; 17% Children’s Trust Fund allocation.

DISCUSSION / BACKGROUND:

CAPCs are governed by California Welfare and Institutions Code (WIC) 18982, which mandates that counties establish a CAPC to carry out specific legislated functions, including child abuse prevention and intervention programs. On April 9, 2002, the Board established a CAPC and designated the Council as the CTF Commission, pursuant to WIC 18966. The CAPC acts as an independent organization, functioning within County government, pursuant to WIC 18983.5. The CAPC’s educational and training activities support child abuse prevention efforts throughout the County. In February 2009, the County began contracting with EDCOE to coordinate CAPC services. EDCOE provides services such as child abuse prevention educational and training activities, support groups, playgroups, early literacy groups, assistance with navigating community resources and services, and developmental screening for children under five years old. The provision of these CAPC services to the community will result in a decrease of child abuse in our community.

 

In July 2021, California’s Family First Prevention Services (FFPS) Program was established in WIC 16585 through 16589 as an opt-in program for counties to develop and implement Title IV-E prevention services as part of comprehensive prevention, early intervention services and to address child well-being. In accordance with WIC 16588, counties opting into the FFPS Program are required to submit a Comprehensive Prevention Plan. Additionally, there were new funding sources available to support the work. On April 19, 2022, the Board approved El Dorado County to opt-in to FFPS and accept additional funding to support the completion of the Comprehensive Prevention Plan components (Legistar file 22-0608). EDCOE has assisted HHSA with coordinating child abuse prevention efforts as part of the continued statewide effort to implement the Family First Prevention and Services Act (FFPSA). EDCOE is a leader in local efforts to plan and implement community wide prevention efforts, including educational and training activities, related to FFPSA. The CAPC Coordinator develops, coordinates, and implements said services as they related to the allocation mandates. EDCOE has been coordinating the CAPC in El Dorado County since 2009 for a total of 16 years.

 

In accordance with Board of Supervisors Procurement Policy C-17, the contractor is exempt from competitive bidding, with Purchasing Agent concurrence, per Section 3.4(2f), which states, the procurement is for services where the continuity of providers will provide efficiency or critical knowledge, and other providers of the services cannot provide similar efficiencies or critical knowledge. The proposed Agreement with EDCOE is a renewal of Agreement #7481 approved by the Board on June 27, 2023, (Legistar file 23-0894) and would ensure continuation of necessary CAPC services without any service interruption. HHSA recommends Board approval on this renewal agreement to ensure continuity in these services. An approved Non-Competitive Bid Justification form is attached.

 

ALTERNATIVES:

Should the Board decline to approve Agreement #9572 with EDCOE, the loss in continuity with this vendor will be a setback to the child abuse prevention efforts as the CAPC continues the statewide effort to implement the FFPSA. The loss will result in reduction of services to the community and reduced CAPC activities. Additionally, disapproval will result in an inability to meet funding source mandates and will negatively impact HHSA's ability to engage in community outreach to support child abuse prevention.

FINANCIAL IMPACT:

There is no Net County Cost associated with this agenda item.  Sufficient appropriations were included in the Fiscal Year (FY) 2025-26 Budget, and will be included in future budget requests for the term of the Agreement.
