Health and Human Services Agency, Public Health Division, recommending the Board consider the following:
1) Approve and authorize the Chair to sign non-financial Memorandum of Understanding 148-M1410 with the County of Sacramento for the coordination of service delivery to HIV/AIDS afflicted populations in El Dorado County for a term to begin upon final signature and to continue into perpetuity until terminated by either party; and
2) Approve and authorize the Chair to sign further amendments to Memorandum of Understanding 148-M1410 which do not affect the term or the maximum obligation and contingent upon approval by County Counsel and Risk Management.
FUNDING: This is a non-financial Memorandum of Understanding. Sacramento County is the fiscal agent of the Federal Ryan White Comprehensive Acquired Immunodeficiency Syndrome Resources Emergency Act Funds.

Fiscal Impact/Change to Net County Cost
There is no fiscal impact or change to the Net County Cost associated with Memorandum of Understanding (MOU) 148-M1410.
Background
The Ryan White HIV/AIDS Program (also known as the Ryan White CARE Act) provides Federal funding (Title 1) to regional transitional grant areas (TGA) for the purpose of planning for and delivery of specialized case management and ambulatory medical care services for people living with HIV\AIDS (PLWHA). Title 1 funding through the TGA provides reimbursement to local jurisdictions to bridge service gaps and eliminate access to care barriers specific to the specialized medical care needs of the HIV/AIDS afflicted population.
The County of Sacramento is designated by the Health Resources Service Agency (HRSA) as the Primary Regional Fiscal Agent for the five-county TGA and receives Title 1 funding that is then passed through the Local Jurisdiction Fiscal Agent (was County of El Dorado) to the Sierra Foothills AIDS Foundation (SFAF) for the provision of comprehensive specialized support services to County PLWHAs and their families.
As a result of an analysis by HHSA staff that identified redundancies that delayed the distribution of funds to SFAF and potentially impacted the delivery of services and continuity of care to the afflicted HIV/AIDS population within the County, on November 5, 2013 (Agenda Item 13-1390, Agenda Number 32) the Board approved HHSA's request that the County relinquish its role as Local Jurisdiction Fiscal Agent for the Ryan White HIV/AIDS Program funds. This action allows for funds to be sent directly to SFAF from Sacramento County. The Board also approved HHSA's request to terminate Cost Reimbursement Agreement 223-F1311 with the County of Sacramento upon the Board's execution of nonfinancial MOU 148-M1410.
Reason for Recommendation
HHSA recommends approval of nonfinancial MOU 148-M1410, which allows the County to remain a member of the Sacramento TGA Title 1 HIV Health Services Planning Council as required by U.S. Dept. of Health and Human Services Health Resources and Services Administration and the California Office of AIDS. Remaining a member of the Sacramento TGA HIV Health Services Planning Council (Planning Council) ensures the County of El Dorado will remain a voting member of the Planning Council and that the County's designated representative will be able to continue to participate in Planning Council activities to determine the size and demographics of the population of individuals with HIV/AIDS, the size and demographics of the estimated population of individuals with HIV/AIDS who are unaware of their HIV status, establish the needs of such populations, and assist with the development of a comprehensive plan for the organization and delivery of health and support services to ensure the interests of El Dorado County are represented.
