Title

Probation Department recommending the Board:

1) Delegate authority to the Chief Probation Officer, to execute the following revenue Memoranda of Understanding (MOUs) between the El Dorado County Probation Department and Superior Court of California regarding the Collaborative Justice Courts Substance Abuse Focus Grant (SAFG) Program awards for Probation to provide services of alcohol monitoring, urine testing, saliva testing, and other technologies to monitor offenders’ compliance in collaboration with Superior Court of California:

a) Retroactive MOU 6732 in the amount of $12,000 for the Grant award period of   September 1, 2019, through August 31, 2020;

b) Retroactive MOU 6733 in the amount of $12,000 for the Grant award period September 1, 2020, through August 31, 2021;

c) Retroactive MOU 6734 in the amount of $12,000 for the Grant award period of September 1, 2021, through August 31, 2022; and

d) An MOU in the amount of $12,000 for the Grant award period of September 1, 2022, through August 31, 2023, contingent upon approval by County Counsel; and

2) Authorize the Chief Probation Officer to execute further documents relating to MOUs, including amendments which do not increase the maximum dollar amount or term of the MOUs, contingent upon approval by County Counsel.

DISCUSSION / BACKGROUND

The Superior Court of California, County of El Dorado (Court), first applied for the California Collaborative Justice Courts Substance Abuse Focus Grant (SAFG) Program in August of 2014. The grant is funded through the Judicial Council of California. The Court has received the SAFG every year since initial application and award. The Court received notification of the first grant award in late 2014 under the terms and conditions of Contract Number 1029398. A second-year application was submitted and awarded in August 2015 under the terms and conditions of Contract Number 1031075. A third-year application was submitted and awarded in August 2016 under the terms and conditions of Contract Number 1032705. A fourth-year application was submitted and awarded in October 2017 under the terms and conditions of Contract Number 1035004. A fifth-year application was submitted and awarded in October 2018 under the terms and conditions of Contract Number 36099. A sixth-year application was submitted and awarded in fall of 2019 under the terms and conditions of Contract Number 45410. A seventh-year application was submitted and awarded in fall of 2020 under the terms and conditions of Contract Number 64739. An eighth-year application was submitted and awarded in fall of 2021 under the terms and conditions of Contract Number 72703. Ninth year funding will be awarded in fall of 2022.

 

The grant is designed to promote innovation through helping grantees maintain, expand, or enhance their collaborative courts. The program is also designed to assist the Court in using drug court principles and substance abuse treatment. The Probation Department’s (Probation) participation in this grant program will be to provide the Court with services to complete the program objectives identified in the MOUs.

 

The revenue MOUs, if adopted, will cover the following terms:

1) MOU 6732; July 1, 2019, through August 31, 2020

2) MOU 6733; July 1, 2020, through August 31, 2021

3) MOU 6734; July 1, 2021, through August 31, 2022

4) MOU TBD; July 1, 2022, through August 31, 2023

 

The MOU dates overlap due to timing of quarterly report processing and invoicing by the Judicial Council of California and the Court.

 

Each SAFG grant award period runs from September 1 through August 31. Probation received the following revenue for the grant periods listed:

 

9/1/2019 - 8/31/2020 $17,523.44

9/1/2020 - 8/31/2021 $30,703.52

9/1/2021 - 8/31/2022 $9,721.86

 

The Fiscal Year breakdowns for Probation revenue received is:

 

FY2019/2020 $22,826.43

FY2020/2021 $27,493.37

FY2021/2022 $15,623.30

 

If additional funds are available during a given grant period, and Probation has had expenditures to support the revenue, the Court will provide additional funding to Probation.

 

Due to changes in staffing at the Superior Court and an oversight by the Probation Department, completion of three successive MOUs from July 1, 2019 through the current period were not completed.

 

Probation has completed all tasks related to the requested retroactive agreements and received the revenue as billed to the Court.

 

In addition to the retroactive MOU approval, Probation is requesting approval of the 22/23 MOU as, due to the timelines of the State budget process, the grant funds are awarded on a retroactive basis and the Court will not receive the agreement from the State until Fall 2022.

 

ALTERNATIVES

The BOS could choose to decline the revenue from the Court for the identified services.  The department would seek to provide support out of General Fund revenue in the 22/23 Budget Year.

FINANCIAL IMPACT

No change to Net County Cost. State funding will reimburse Probation for the actual cost of continuous alcohol monitoring provided for in the attached MOUs.
