DISCUSSION / BACKGROUND
This Board item represents the first annual report of real property acquisitions pursuant to Ordinance 5181. For this annual reporting period of September 21, 2023, through June 30, 2024, only real property acquisitions for approved Capital Improvement Program (CIP) projects have been executed. During this period, the Department of Transportation (Transportation) Right of Way Unit acquired two (2) individual acquisitions under Ordinance 5181 totaling $36,200, ranging from $14,600 to $21,600 per acquisition.
This Board item also represents the final annual report of real property acquisitions pursuant to Ordinance 5094 representing the annual report period of July 1, 2023, through September 20, 2023. Only real property acquisitions for approved Capital Improvement Program (CIP) projects have been executed. During this period, Transportation acquired three (3) additional individual acquisitions under Ordinance 5094 totaling $10,500, ranging from $1,000 to $6,500 per acquisition.
This resulted in a total cost of $46,700 for Fiscal Year 23/24. Please refer to Attachment A for the current annual report, which provides an itemization of each acquisition’s associated CIP project, funding, parcel or easement cost, and purpose.

PRIOR BOARD ACTION
On October 9, 2018, Legistar File 18-0994 v2, the Board approved Ordinance 5094 which requires an annual report to the Board of real property acquisitions, instead of the previous reporting requirement of twice a year. This ordinance became effective on November 8, 2018.
On August 22, 2023, Legistar File 23-0801 v2, the Board approved Ordinance 5181 updating Ordinance 5094 clarifying Director of Transportation and Deputy Director of Engineering authorities and the exemption of this Ordinance from the California Environmental Quality Act. This ordinance became effective on September 21, 2023.
OTHER DEPARTMENT / AGENCY INVOLVEMENT
Transportation staff work with County Counsel to facilitate acquisitions on an as-needed basis.

FINANCIAL IMPACT
There is no fiscal impact or net County cost associated with this item. These real property acquisitions were made using various funding sources as detailed in Transportation's CIP, and described in Attachment A.
