Environmental Management Department recommending the Board:

1) Accept a grant award funded through the California Tire Recycling Management Funds from the State of California, Department of Resources Recycling and Recovery, Fiscal Year 2018-19 Local Government Waste Tire Enforcement Grant, in the amount of $75,967, for the term of June 30, 2019 through September 30, 2020; and

2) Delegate authority to the Environmental Management Department Director, or designee, to execute the Grant Agreement (Attachments B, C, D, and E) and all grant related documents including, but not limited to, amendments, requests for payment, reports, and all associated documents necessary to secure and expend the funds for the purpose of implementing this Local Government Waste Tire Enforcement Grant Program.

DISCUSSION / BACKGROUND

Pursuant to the Tire Recycling Act (Senate Bill 937, [Vuich, Statutes of 1990, Chapter 35]) and related legislation, and on behalf of the California Tire Recycling Management Fund, the State of California, Department of Resources Recycling and Recovery (CalRecycle) is responsible for administering the Waste Tire Enforcement Grant Programs, including the Fiscal Year 2018-19 Local Government Waste Tire Enforcement Grant Program (Waste Tire Enforcement Grant Program) which provides funding to city and county agencies in California for waste tire enforcement activities for the furtherance of the effort to reduce, recycle, and reuse solid waste and hazardous material statewide thereby preserving landfill capacity as well as protecting public health, safety, and the environment.

 

CalRecycle administers various payment programs and grants, and provides oversight for California’s waste handling and recycling programs, which are managed at the local level by cities and counties. CalRecycle’s procedure for administering payment programs and grant applications require the applicant’s governing body to declare by resolution certain authorizations related to the administration of these funds. The Board’s acceptance of the funds under this CalRecycle Waste Tire Enforcement Grant Program will ensure that the Environmental Management Department (Environmental Management) is able to contribute towards the efforts to reduce the number of tires that are illegally disposed of and promote proper disposal and recycling of waste tires.

 

On December 18, 2018, Environmental Management submitted an application to CalRecycle for the Waste Tire Enforcement Grant in the amount of $75,906.59 (Attachment E). On April 3, 2019, notification was received from CalRecycle advising the award of the Waste Tire Enforcement Grant Program to the County in the amount of $75,967 during the 2018-19 grant cycle, with a term of June 30, 2019 through September 30, 2020 (Attachment F). The Waste Tire Enforcement Grant Program Agreement, along with the referenced Exhibits, must be executed by the County and returned to CalRecycle within 60 days of the Notice of Award.

 

In order to achieve the goals established for this Waste Tire Enforcement Program, Environmental Management intends to use the awarded funds for the following items:

                     Conducting inspections and preparing reports on waste tire facilities to ensure compliance with current waste tire laws and regulations;

                     Conducting investigations of illegal waste tire disposal activities;

                     Identifying and issuing notices of violation to non-compliant commercial businesses and residences;

                     Conducting and reporting surveillance, investigations, and other enforcement activities to remediate waste tire disposal and hauling;

                     Performing field patrolling and small cleanup activities;

                     Referring all illegal and unregistered waste/used tire haulers to CalRecycle; and

                     Providing program related outreach and training to local businesses.

 

In accordance with Board of Supervisors Policy A-6, the Board is the sole authority for accepting grant awards and approving grant agreements. After acceptance of a grant award and approval of the grant agreement, the Board may delegate authority to execute all documents, including, but not limited to, the grant funding agreement, amendments, request for payments, reports, and all other associated documents necessary to secure and implement the approved grant payment program.

 

The recommended acceptance of these funds authorizes the Director of Environmental Management, or designee, to execute all reports and associated documents necessary to secure and expend the funds for the purpose of implementing this Waste Tire Enforcement Grant Program. Environmental Management will continue to obtain Board approval for the acceptance of all funds pursuant to Board Policy A-6.

 

ALTERNATIVES

The Board could choose to deny the acceptance of these grant funds. This would result in the forfeiture of the available grant funds awarded under this Waste Tire Enforcement Grant Program to the County. This funding opportunity provides for additional resources for County staff to perform waste tire enforcement activities and other tasks related to the County’s efforts to eradicate waste tires and illegal dumping of tires throughout the County.

County Counsel has reviewed and approved the Grant Agreement.

It is recommended that the Board approve this item.

 

FINANCIAL IMPACT

There is no change in Net County Cost.  No matching contributions are required for this Waste Tire Enforcement Grant Program. These funds have been included in the FY 2019/20 budget.
