Health and Human Services Agency (HHSA) recommending the Board:
1) Approve and authorize the Chair to sign Agreement for Services 095-S1811 with El Dorado County Office of Education for the provision of Child Abuse Prevention Council Activities for a three-year term commencing upon execution, with a maximum contractual obligation of $405,000;
2) Authorize the Purchasing Agent, or designee, to execute further documents relating to Agreement for Services 095-S1811, including amendments which do not increase the maximum dollar amount or term of the Agreement, and contingent upon approval by County Counsel and Risk Management; and
3) Approve and authorize the HHSA Director to sign a termination letter, pursuant to Article XXVI, “Default, Termination, and Cancellation,” Section D, “Termination or Cancellation without Cause” in Agreement for Services 027-S1511 with El Dorado County Office of Education, to be effective upon execution of this Agreement for Services 095-S1811 with El Dorado County Office of Education.

DEPARTMENT RECOMMENDATION
Health and Human Services Agency (HHSA) recommending the Board approve Agreement for Services 095-S1811 with El Dorado County Office of Education to provide Child Abuse Prevention Council (CAPC) activities. Welfare and Institutions Code (WIC) 18983 mandates that Counties fund a child abuse prevention coordinating council. County of El Dorado began contracting with El Dorado County Office of Education in 2009 for the provision CAPC activities. The CAPC educational and training activities support child abuse prevention efforts throughout the County.
Additionally, HHSA has determined, in accordance with County Ordinance Section 3.13.030 and WIC 18983.5, legislative authority mandates that the service be performed by independent contractors.
DISCUSSION / BACKGROUND
Child Abuse Prevention Councils are required under WIC 18983, which mandates that counties establish a CAPC in order to carry out specific legislated functions, including child abuse prevention and intervention programs. On April 9, 2002, the Board established a CAPC and designated the Council as the Children’s Trust Fund Commission, pursuant to WIC 18966. In 2009, the County began contracting with El Dorado County Office of Education to coordinate CAPC services. CAPC acts as an independent organization, functioning within County government, pursuant to WIC 18983.5.
Services provided through this Agreement are funded in part by the Community-based Child Abuse Prevention allocation; the Promoting Safe and Stable Families allocation; the Child Abuse, Prevention, Intervention, and Treatment allocation; and the Children’s Trust Fund allocation. The CAPC Coordinator develops, coordinates, and implements said services as they relate to the allocation mandates.
This Agreement adds the service of Community Hubs. Community Hubs serve to offer a local point of access for services and outreach to isolated families in the surrounding communities. As with the other services provided though this Agreement, the CAPC will focus on educational and training activities to support child abuse prevention efforts throughout the County.
HHSA recommends terminating Agreement for Services 027-S1511, which is the existing CAPC Agreement with services provided through EDCOE. Agreement for Services 027-S1511 does not include the Community Hubs service and the term is perpetual. Replacement Agreement, 095-S1811 adds Community Hubs and changes the term to three (3) years.
ALTERNATIVES
Disapproval of Agreement for Services 095-S1811 will result in an inability to meet funding source mandates. Disapproval also will negatively impact HHSA’s ability to engage in community outreach to support child abuse prevention.

FINANCIAL IMPACT
There is no Net County Cost associated with this Agenda item. Sufficient appropriations were included in the fiscal year 2017-18 budget, and will be included in future budgets for the term of the Agreement.

1) Clerk of the Board to obtain signature of Chair on two (2) original Agreements for Services 095-S1811.
2) Clerk of the Board to return one (1) fully executed Agreement to the HHSA Contracts Unit at 3057 Briw Road.
