DISCUSSION / BACKGROUND:

The California Welfare and Institutions Code (WIC) Section 5604 requires all counties to establish a mental health advisory board or commission.  The County of El Dorado Board of Supervisors (Board) established the El Dorado County Behavioral Health Commission (Commission) and adopted Bylaws for the Commission through previous actions on May 11, 1993, February 29, 2000, October 21, 2014 (File ID: 14-1254), and April 21, 2018 (File ID:18-0567).

 

The Behavioral Health Commission serves in an advisory role to the Board of Supervisors and the HHSA Behavioral Health Division regarding the behavioral health needs of the El Dorado County community.  By advising the Board and HHSA Behavioral Health Division staff, the Commission promotes improved quality of life for all County residents with mental health needs.

 

In late 2022, the Commission determined the need to review its Bylaws to align them with their current operations and to ensure compliance with current statewide best practices. The Commission discussed proposed Bylaw revisions with the Board on November 16, 2022 (File ID: 22-1884), in which the item was set to be continued at a later date upon final revisions. This action item incorporates those changes, which includes several minor changes to the Bylaws of this Commission. Attachment C to this item shows the current Board adopted Bylaws; Attachment A and B (redline) show the proposed revisions to these Bylaws.

 

A summary of the primary proposed changes to the Commission Bylaws is as follows:

1. Changes to ARTICLE V, MEMBERSHIP:

o Changes to Article A, Composition of Commission and Article B, Term: Change to the number of Commission members from sixteen regular appointed Board members to eleven in accordance with WIC Section 5604, which stipulates ten to fifteen members. 

o Change to Article C, Commission Composition Update any mention of the prior Commission name, changing the title from Mental Health Commission to Behavioral Health Commission

o Addition of Item 4 to Article F, Vacancies and Reappointments of Commission members: to allow discharge from the Commission based on lack of attendance or performance of duties

2. Change to ARTICLE VII, MEETINGS:

o Change in paragraph 2 of meetings: change from no fewer than ten times per year, to monthly whenever possible

o Change to paragraph 5 to add additional public comment and meeting length parameters

3. Change to ARTICLE VIII, MEETINGS, QUORUM AND RULES OF ORDER:

o Additions of terms to this article (items 1-3)

4. Change to ARTICLE X, COMMITTEES:

o Addition of Article B, Standing Committees and Brown Act Compliance

o Deletion of prior language regarding Membership Committee Responsibilities

5. Additional language to ARTICLE XI, AMENDMENTS:

o Added Procedures for amendment Bylaws

 

HHSA is recommending the Board adopt and authorize the Chair to sign the attached Resolution, thereby adopting and approving revisions of the Bylaws, and superseding Resolution No. 058-2018.

 

ALTERNATIVES:

Should the Board decline to approve this recommendation, the Behavioral Health Commission will continue to function under the existing bylaws.
