Fiscal Impact/Change to Net County Cost:
The contract is funded from sources appropriate to each Task Order.  For example, review of development proposals is charged to developers, signal design work is funded as part of the applicable specific project (e.g. impact fees), and work related  to General Plan implementation is funded from the Road Fund.  The Department has sufficient revenues budgeted for Task Orders issued to date on this contract, and will confirm available funding with the issuance of all new Task Orders.  There is no cost to the County General Fund.
 
Background:
On February 15, 2005 the Board approved Agreement for Services AGMT 04-721 with Fehr & Peers Associates, Inc. to provide traffic engineering services associated with transportation planning, development review and signal review on an "as-needed" basis for a period of two years with a not-to-exceed amount of $300,000.  Services include traffic impact modeling in support of the Department's forecasting and planning efforts; review of traffic impact analyses, studies and reports submitted by developers in connection with proposed development projects; preparation of planning and engineering reports in connection with the Department's transportation planning and engineering efforts; preparation of traffic signal designs and operation support for the Department's efforts to increase traffic flow and safety through the County's road intersections and freeway interchanges.
 
On July 19, 2005 the Board approved Amendment I to this agreement increasing compensation by $300,000 for a total not-to-exceed amount of $600,000.  On May 16, 2006 the Board approved Amendment II to this agreement to amend the scope of services to clarify contractual provisions allowing the Department to authorize Fehr & Peers to utilize sub consultants and to ratify their use on existing task orders.
 
Amendment III would increase the term of the contract for one additional year and increase compensation by $100,000 for a total not-to-exceed amount of $700,000.   A new Fee Schedule is also included for the term of the Amendment.
 
Reason for Recommendation:
During the Agreement's initial two-year term, the Consultant has assisted the Department with development of traffic impact fees in support of efforts to implement the General Plan, the design and/or review of traffic signal designs and other traffic engineering improvements for on-going projects.  These services continue to be of vital assistance to the Department to conduct timely plan reviews as mandated by Title 15 of the County Ordinance Code.  
 
During the term of the proposed amendment, the Consultant may assist the Department by development of regional traffic studies within three specific regions in the County:  El Dorado Hills, Cameron Park, and the Missouri Flat Corridor.  The intent of these studies will be to:
 
1.  Minimize the number of Developer funded, project specific, Traffic Studies that are prepared and reviewed.
2.  Quantify the existing level of service of the street segments, intersections, highway segments, and interchanges.
3.  Give the County a rough estimate of both the amount and type of development growth these regions can absorb, taking into consideration the Capital projects that are being advanced by the County and private developers.
 
The Department recommends that the Board find that pursuant to Article II, section 210 b (6) of the El Dorado County Charter that there are specialty skills required for the work performed under this Amendment that are not expressly identified in County classifications.  The El Dorado County Employees Association, Local #1 has been informed of this proposed Amendment.
 
Consultant Selection:
Fehr & Peers Associates, Inc. was originally selected for their transportation planning and traffic engineering services based on the unique qualifications they demonstrated previously in the quality work they provided to the Department during development of the County's General Plan.
 
Several other firms are also providing traffic engineering and traffic signal design services to the County that are comparable to those provided by Fehr & Peers.  At the time the original Agreement was developed, Fehr & Peers Associates was one of three qualified firms available to provide the County with the services described in the previous section; the other two were Dowling Associates, Inc. and Wilbur Smith Associates.
 
At that same time, Dowling Associates was engaged as a sub consultant under a $300,000 contract with HDR Engineering, Inc. to provide the Department with the draft US 50 Corridor Strategic Planning Traffic Operational Study Report.  (Dowling Associates has since entered into a contract directly with the County.)  Wilbur Smith Associates was also a sub consultant to HDR to provide analysis of traffic operations in the vicinity of the El Dorado Hills Boulevard and Silva Valley Parkway Interchanges.
 
During the proposed one-year term of Amendment III, the Department will continue pressing to hire qualified staff and increase utilization of in-house resources to process and approve improvement plans.  At the same time, the Department will also release a Request for Qualification (RFQ) as required in Procurement Policy C-17 for contracts exceeding $100,000.  The RFQ will be released to identify and evaluate consultants interested in providing outside plan check and review services on an as-needed basis.  The Department intends to have professional service agreements with selected consultants in place in January 2008 to handle periodic plan check demands that exceed Department resources.
 
Action to be taken following Board approval:
1.  The Chairman will sign two originals of Amendment III to Agreement for Services #AGMT 04-721 with Fehr & Peers, Associates, Inc.
2.  The Department will forward one original to the consultant.
