Environmental Management Department recommending the Board:
1) Accept grant award through the California CUPA Forum Environmental Protection Trust Fund in the amount of $106,663.81 for the purchase of a MX908-c portable mass spectrometer;
2) Approve and authorize the Chair to sign Agreement 2022-03 and to execute all grant documents, including, but not limited to, the grant funding agreement, amendments, requests for payments, reports, and all associated documents necessary to secure grant funds for the purpose of implementing the grant agreement for the term July 1, 2022 to June 30, 2024; and
3) Approve and add the purchase of the MX908-c equipment listed herein to the Fiscal Year (FY) 2022-23 fixed asset list.

DISCUSSION / BACKGROUND
The California CUPA Forum Board established the CUPA Forum Environmental Protection Trust Fund (Trust) to enhance the investigation and enforcement of the State of California statutes and associated implementing regulations as related to hazardous materials and hazardous waste. The Trust was established to disburse and manage monies primarily from case settlements as adjudicated through the efforts of local, State, and Federal prosecutors.
EMD submitted a grant application in the amount of $106,663.81. On May 17, 2022, EMD received notification of the grant award, and subsequently received the grant agreement to execute in the amount requested, $106,663.81 (Attachment A). The grant will be used to purchase an MX908-c portable mass spectrometer, a handheld chemical detection system for gas/vapor, liquids, solids and aerosols. This unit will be used to assist in providing positive chemical identification during both field inspections of regulated facilities and during emergency response activities.
In accordance with BOS Policy A-6, the Board of Supervisors is the sole authority for accepting grant awards and approving grant agreements. After acceptance of a grant award and approval of the grant agreement, the Board may delegate authority to execute the grant agreement and other grant-related documents.

FINANCIAL IMPACT
There is no change in Net County Cost. No matching funds are required for this grant agreement. If approved, a budget amendment to include these grant funds and this equipment cost will be included in Environmental Management's request as part of the FY 2022-23 Adopted Budget process.
