Health and Human Services Agency recommending the Board adopt and authorize the Chair to sign Resolution 019-2025, superseding Resolution 113-2023, to adopt the updated Bylaws of the El Dorado County Behavioral Health Commission pursuant to California Welfare and Institutions Code Section 5604, authorizing review and evaluation of the community’s behavioral health needs.

DISCUSSION / BACKGROUND:
WIC Section 5604 requires all counties to establish a mental health advisory board or commission to serve in an advisory role to its governing body which shall be appointed by said governing body. The Board established the El Dorado County Behavioral Health Commission (Commission) and adopted Bylaws for the Commission through previous actions on May 11, 1993, February 29, 2000, October 21, 2014, April 21, 2018, and July 25, 2023 (Legistar files 14-1254, 18-0567 and 23-1007).
The Commission serves in an advisory capacity to the Board and HHSA’s Behavioral Health Division, providing guidance on the behavioral health needs of the community. Through its advisory role, the Commission supports efforts to improve the quality of life for all County residents with mental health needs.
In late 2024, the Commission recognized the need to review its Bylaws to ensure they align with current operations and adhere with statewide changes to Commission bylaws, duties and membership requirements outlined in Senate Bill 326. On November 20, 2024, the Commission discussed proposed Bylaws and approved revisions (Legistar file 24-2067). This agenda item incorporates those revisions, which reflect several minor updates to the Commission’s Bylaws. Attachment C contains the current Bylaws as adopted by the Board, while Attachments A and B (redline version) show the proposed revisions.
A summary of the primary proposed changes to the Commission Bylaws is as follows:
1. Change to ARTICLE II, DEFINITION:
- Change to term of a medical diagnosis.
2. Change to ARTICLE III, AUTHORITY:
- Added prior Resolutions.
3. Change to ARTICLE IV, OBJECTIVES:
- Change to Item 1, to add specification to parameters of review and evaluation of community needs.
- Change to Item 2, moved acronym for WIC and added Section number to WIC.
- Change to Item 3, to make a noun plural.
- Addition of Item 5, requirement of a public hearing to be conducted on the draft integrated plan and annual updates.
4. Change to ARTICLE V, MEMBERSHIP:
- Change in title of Item A to Commission Membership and added Section number to WIC.
- Change to Item C, Conflict of Interest to add Section numbers to WIC and Government Code.
- Change to Item D, Commission Composition to add membership requirements to include one employee from a local education agency and one Veteran or Veteran advocate.
- Change in first paragraph to Item F, Vacancies and Reappointments to add Section number to Government Code.
- Change to Item G, Compensation to add Section number to WIC.
5. Change to ARTICLE VI, OFFICERS:
- Deletion of BHC acronym.
- Change in time frame of when elections shall be held and establishing an effective date post-election.
6. Change to ARTICLE VII, MEETINGS:
- Change in paragraph 1 to add Section number to Government Code
7. Change to ARTICLE VIII, MEETINGS, QUORUMS, AND RULES OF ORDER:
- Change to Item 2 to remove specification regarding members on leave of absence.
8. Change to ARTICLE X, COMMITTEES:
- Deletion of subtype, Standing Committees.
- Change in paragraph 1, to remove allowance that Commission Chair may appoint standing committees.
- Deletion of Item B, Standing Committees and Brown Act Compliance.
- Change to Item B, Ad Hoc Committees, to remove requirement that a regular member of the Commission shall chair all committees, standing and ad hoc.
HHSA is recommending the Board adopt and authorize the Chair to sign the attached Resolution, thereby adopting and approving revisions of the Bylaws, and superseding Resolution No. 113-2023.
ALTERNATIVES:
Should the Board decline to approve this recommendation, the Behavioral Health Commission will continue to function under the existing bylaws.
