Supervisor Sweeney recommending the Board approve and accept the Highway Easement Deed tendered to the County by the Federal Highway Administration dated March 9, 2011. Authorize the Chairman's to sign the Highway Easement Deed, the All-Purpose Notary Acknowledgement form and the Certificate of Acceptance, and to authorize the Director of Transportation, or her designee, to have recorded said Highway Easement Deed.
The letter from the County thanks the FHWA and sets forth some concerns. While we accept the tendered easement, we do not believe the documents attached thereto are appropriate as the maintenance and weed control requirements. They set forth undue burdens on the County and we are working on appropriate operational requirements for all of our roads crossing Federal Lands with the Eldorado National Forest. The FHWA is reluctant to change the Exhibits and has a further concern over future grants if this easement is not accepted as is!
