Fiscal Impact/Change to Net County Cost: There is no Net County Cost associated with this Agreement. This funding was anticipated and included in the fiscal year (FY) 2011-2012 Budget.
Background: Historically, Sacramento County was the applicant/fiscal intermediary for the Federal Housing and Urban Development (HUD)/Housing Opportunities for Persons with AIDS (HOPWA) grant funding, allocating funds to rural counties including the County of El Dorado. This responsibility transitioned to the Sacramento Housing and Redevelopment Agency (SHRA) effective January 1, 2012, who now serves as the fiscal intermediary for HOPWA grant allocations.
The HOPWA Program provides emergency housing assistance for County of El Dorado residents and their families living with HIV disease. Short term assistance and supportive services are provided to qualified persons for rent, mortgage, and utilities to prevent homelessness.
Currently HOPWA services are provided by Sierra Foothills AIDS Foundation, a community-based agency specializing in services for individuals and families afflicted with HIV/AIDS. Sierra Foothills AIDS Foundation maintains all appropriate credentialing and has successfully passed annual site reviews. The Agency anticipates renewal of the current contract with Sierra Foothills AIDS Foundation to provide services funded by this Agreement with SHRA for the term January 1, 2012 through December 31, 2012.
Compensation for Services: SHRA will reimburse the County for actual costs as detailed on the Electronic Claim Form provided by SHRA. Claims shall be submitted by the fifteenth (15th) of each month.
Contract Termination: This Agreement may be terminated for the following reasons: 1) If either party fails to fulfill its obligations under this Agreement in a timely and proper manner or violates any of the covenants, agreements or stipulations of this Agreement, and if such failure or violation is material and substantial, the other party shall have the right to terminate this Agreement by written notice to the defaulting party; 2) by SHRA for cause should the County of El Dorado fail to meet the terms, conditions, and/or responsibilities of the Agreement. SHRA may terminate this Agreement, at any time and without cause, by a notice in writing from SHRA to El Dorado County. In the event of termination prior to the end of the term of this Agreement, SHRA must pay to the County of El Dorado an amount which bears the same ratio to the total compensation under this Agreement as the services actually performed by the County of El Dorado bear to the total services of the County of El Dorado covered by this Agreement, less payments of compensation previously made.
Retroactive Term: This Agreement was received from Sacramento Housing and Redevelopment Agency in January 2012. Several contract language discrepancies were found at that time requiring further communication with SHRA and modification of the original contract terms resulting in a delay for final processing. All reasonable efforts were taken to advance the agreement in a timely manner to the Board.
Reason for Recommendation: Approval of this funding Agreement will allow the Agency to continue providing HOPWA services to the community.
Action to be taken following Board approval:
1. Chair to sign three (3) original Agreements 426-F1211.
2. Chair to sign three (3) original Certification of Authority.
3. Chair to initial three (3) original Attachment 1 - Contract Provisions.
4. Chair to initial three (3) original Attachment 2 - CDBG and Other Federal Requirements
5. Board Clerk's office to return all signed documents to Public Health.
6. Public Health to forward all signed documents to Sacramento Housing and Redevelopment Agency for final execution.
7. Upon receipt of fully executed Agreement from Sacramento Housing and Redevelopment Agency, Public Health to forward original to Board Clerk's Office.
